    I'm conflicted here.
On one hand, these are horrible people, but on the other, they do have first ammendment rights.
Depending on how the sheriff warned them, it might count as trespassing though.

It's a shame there are such groups that seem intent on being the miserable PoS's they are. But did they break a law? If throwing people in jail for being ***holes is to be accepted, we'd all be awaiting the death penalty.

Oh come on, we all know it was wrong. We all know that they will now sue the Sheriff's butt off. But let us for the moment enjoy the thoughts of those SOBs sitting in a Texas jail cell, whining about being there...

I take solace in the thought they may wind up in a far worse place, for a far, far, far longer time someday.:D

It's their entire MO. The "church" is largely composed of one extended family, which are coincidentally lawyers. They go around finding ways to be obnoxious to try to provoke a reaction, then it's lawsuit lottery time. They can represent each other, so if any money comes their way, they get it all.

I don't know if a Sheriff has the power, but in some way "protest at a funeral" should be punishable as trespass. First Amendment violation? Not really. One's right to free speech does not obligate another to provide a forum for it. You have the right to assemble peaceably, but you don't have the right to do it here. If you don't shut up and leave, we have some rooms for you. Just a few little things could effectively shut these people down.

TX is a big place with a lot of counties. They could be arrested, held for 24, not charged and released many times over before they could exit the state.

I'd take this story with a big grain of salt, (the arrest part, not the threat to arrest). There is no mention of it anywhere else on the web, except that forum. Members of the WBC being arrested would make local news headlines, at the least, probably national news. That said, the sheriff was out of line. And, if he carried out his threat he'd be sued to oblivion.
