    This isn't directly related to guns but since it is my LTCH application and I've been amazed how helpful everyone is just from lurking I thought I'd ask.

    The "Have you ever been convicted of any
    misdemeanor or felony violation, including DUI?" I'm having trouble answering, mainly because I'm not sure if I have. The item in question is "failure to provide drivers license" or however it's phrased. A month and a half ago I left my wallet at home when I was in a rush to leave the house and wouldn't you know, on my way home that night I got pulled over by an officer who was going to write me a warning/tell me my plates had expired a week ago, however I didn't have my drivers license on me and I got written a ticket for it. Since then I've paid it, got new plates, lost the paperwork and have no clue if that is considered a misdemeanor. I doubt it's a disqualifying offense either way, but the felony, 3 years in the slammer, and $10,000 fine makes me want to be very careful and accurate in filling it out.

    TL;DR is Failure to Provide License a misdemeanor?

    You got it resolved, you will be fine. I got popped a couple years ago for expired plates and I didn't have my insurance card with me at the time. Went to court and took care of it. No issues with getting my LTCH.

    Generally, just not having your license on you (when you hold a valid license) is an infraction, which is a civil matter and below even a misdemeanor.

    Not to post a resume', but I'm an Indiana attorney with 14 years of practice.

    An individual holding a permit or license issued under this article must have the permit or license in the individual's immediate possession when driving or operating a motor vehicle. The permittee or licensee shall display the license or permit upon demand of a court or a police officer authorized by law to enforce motor vehicle rules.

    Burns Ind. Code Ann. § 9-24-13-3

    A person who violates this chapter commits a Class C infraction.

    Thanks for all the help guys. I was pretty sure I was going to be good, and it sounds like I will be.

    Oh Kirk if it was 9-24-13-3 based on what Houghmade said I'm good, if it was 9-24-1-1 then 9-24-1-8 says its an infraction as well so I should be good either way.

    On my second 4-year application( I now have lifetime),I was called by the State Police because I checked no to the box; "Have you ever been convicted of a felony...etc.. Then he asked me about the POSP(Kirk can tell you what that means). I stated that I was not convicted, but a victim of circumstance, not even tried so I checked "NO". And I asked why it came up now and didn't before.

    He said that they probably checked a different database and that I should just write "POSP", no conviction and return it to him. A couple weeks later, I got my license.

    Understand that in 17 years of practice, when people say "no license" it can be everything from 9-24-1-1 to HTV-Life.:D

    I always ask what the statute was.

    That's what that extra 3 years gets you. I just recently stopped believing that "a couple of beers" meant "a couple of beers". ;)
