About time. I was on the side of the "police can rightfully assume the carry was illegal until proven otherwise" not because I wanted to be but because I thought it was the most plain reading of Indiana law. I am pleased the court disagrees with me.

    Hey Guy,

Might be worth an edit that Pinner might be Rucker's last opinion as the lead author, given his retirement. Quite the last hurrah!

Yup, I welcomed the ruling. So what many of us believed to be the best practice is now the law. Works for me. Posted this on my Facebook to get the word out. Sometimes the dept takes time to update the officers.

    Same.

It's been our dept. policy for awhile now to not detain based solely on a firearm, but this is the first case law I'm aware of that will force the issue for departments without such a policy.

"Stop and frisk", has always been a grievance to the United States Constitution, and it`s asinine that police could make an assumption that simply by virtue of being armed a citizen was up to no good. Outstanding ruling!

I gotta remember the phrase "felon with a gun is not the default setting" and another I forgot.
