“There was a family situation at the house and as one of the people involved were leaving, Don came outside with a pistol, and the other person had a pistol in his car,” Sheriff Swain said. “He got his gun and shot Don one time.”
I read that as 1) there was a "family incident" 2)the deceased came out of his house and pointed his gun at the person in the car, who then fired.Be interesting to see how this plays out. Seems the person who shot him had the chance to leave if they went to the car to get their gun then returned to some extent to shoot him
A fine example of why you don’t pull out your gun unless you plan to shoot.
If it's an influential family, the shooter will get a diversion agreement or mental health diversion.
