Blockbuster announcement: McLean Co. State’s Attorney says “No charges for FOID holders merely exercising 2nd Amendment rights” | GUNS SAVE LIFE

In short, McLean County State's Attorney has called Illinois' prohibition on right-to-carry unconstitutional and he's not going to prosecute FOID-card holding gunowners for merely exercising their rights under Heller and McDonald.

Governor and AG are defecating bricks. IL State Police apoplectic. I expect the usual characters to proclaim the sky will soon fall in their shrill voices.

This has the potential to be huge. It's almost like a rebellion of sorts among IL State's Attorneys regarding IL lack of right to carry if they get more on board.

Are you saying ppl in Chicago can carry with a FOID card? That would be huge. The gun death rate would probably spike as all those gang members got shot while trying to rob or shoot someone else, and then it should stabilize for the first time in decades. Proof that guns in the hands of law abiding citizens is not the problem, but the solution.

Chicago is in [STRIKE]Crook[/STRIKE] errr, Cook County. I seriously doubt that, since they routinely ignore Federal Law and Court Rulings, Reidents will ever be able to carry without being harrassed incessantly by CPD.

The Foid card does not allow a person to carry a loaded weapon off private property. It allows a person to posses a firearm or ammunition. I have not seen anything in the local paper about it yet.

Many downstate counties are in favor of a carry permit/license the problem they have is Chicago has enough power to defeat it.

Too bad they can't simply secede and join us as Hoosiers.

They need to secede and let the socialists up north fend for themselves for awhile.

Let Chicago be it's own City State? A great thought, but Could that work?

I have a few questions on that subject:

Would they still get 2 Senators and Representatives based on population?
The city controls Il politics as it is, what good would giving the socialists even more voice in the Federal legislature be?

Where would the legal boundaries be drawn? Chicago, itself is geographically small, but add in all the sububurbs and you've got a lot of people and land holding.

Since the city is broke, would they get a bail out from the .gov to maintain their corrupt ways and keep the sheep fed? I doubt they would be made to fend for themselves, unfortunately.

Chicago is in Cook County. The AG in the article is from a DIFFERENT county so this won't help anyone in Cook County.

So basically if he makes the announcement it's only good for 60 or so days since after he retires the next AG can say we will prosecute.

However this AG's annoucement reminds me a lot of this:

This is largely symbolic as I suspect the next State's Attorney could elect to file charges, although the guy who's slated to replace Dozier is strongly pro-gun as well.

IANAL, of course and I absolutely would NOT go around strapped, double-dog daring a cop to arrest me.

This is for McLean County - Bloomington - Normal, IL. Home of the Illinois State University Redbirds. There's a whole lot of Illinois that isn't in Cook County (Chicago).

Chicago is in Cook County, but the Attorney General of Illinois is Lisa Madigan (yes, that Madigan). She is outspokenly anti-gun.

So basically if he makes the announcement it's only good for 60 or so days since after he retires the next AG can say we will prosecute.

There seems to be some confusion. The Attorney General of Illinois made no such statement.

This was a statement by the State's Attorney of McLean County, Illinois. He is the CLEO of that county and that county only. A State's Attorney is equivalent to Indiana's Prosecuting Attorney (i.e. the county prosecutor or just "prosecutor").

This is largely symbolic as I suspect the next State's Attorney could elect to file charges, although the guy who's slated to replace Dozier is strongly pro-gun as well.

    Direct hit.

Most of Central and Southern Illinois is livid at allowing Chicago to set state law, this includes the state's gun laws. Heck the Constitution of Illinois was rewritten to permit gun control laws proposed by the Chicago Machine (i.e. Daley the First).

Much of Central and Southern Illinois is like Indiana in politics and culture and many have family ties to Indiana as well as other states. They see people in Indiana, Missiouri, etc. with carry licenses and ask themselves how they are any different. McLean County is the political hotbed of resistance to the Chicago Machine and their gun control agenda.

The problem is that Chicago is enormous and wealthy. They have the say over what goes on in Illinois.

Thanks for the corrections Kirk. Yes I was referring to the "atty" in that county and not the top atty (AG) of the state of IL.

But while it's a small victory for IL it will be short lived. Chicago has a way of making sure that what it does not like goes away one way or the other.

Ok, yeah, I see that now but I was confused as INGO throws around "AG" when they mean something else so I really did not know where you were going. Sorry.

I think some think that AG is some sort of Super Prosecutor that runs around telling other prosecutors what to do. Or maybe like that Agent from The Matrix?

If I were a resident of Illinois, my fingers would cramp from continuously writing State and Federal Legislatures about circumventing the Constitution. I can't believe that the NRA has not been able to correct this situation.
