    While discharging a weapon "might" be accidental - hitting yourself or someone you didn't intend to shoot is without any doubt - negligence.

    I don't get the whole #2 thing. Mayhap I am missing something, but I leave it holstered, dropping trou to calf level. Everything stays in place. Is there something I am missing here? Should I be unholstering for a specific reason?

    Same. No reason to unholster. Too much room for operator error If you do so.

    Depends on whether the act (or action) was willful or not.

    This was willful, therefore 'negligent'.

    The person intended to shoot themselves?

    Accidental
    happening by chance or accident; not planned; unexpected:

    Willful
    deliberate, voluntary, or intentional

    He could easily have been negligent in his regards to safety, but the act of discharing the weapon remains accidental unless we're just going to ignore the meaning of words in order to prove whatever point the whole ND vs AD debate is trying to prove.
