If he's an American citizen, he's committing treason and/or sedition. He's already inspired at least two bombing attempts that have been made public. In my mind, that makes him an active enemy in the War on Terror, subject to arrest, if possible, and killing, if not possible to arrest him.

Once again, the division is made clear. Are you more concerned about your liberties or your safety? Following the constitution, or using terror tactics against enemies of the state? Restraining or expanding the power of the government? Due process or secret police black ops?

Judge Bates asked but did not answer the troubling question, "How is it that judicial approval is required when the United States decides to target a U.S. citizen overseas for electronic surveillance, but that, according to defendants, judicial scrutiny is prohibited when the United States decides to target a U.S. citizen overseas for death?"

Come on Judge, we are AT WAR. That mean means we can tell the courts to stuff their checks & balances where the sun don't shine.

The lawsuit also asked the court to order the government to disclose the legal standard it uses to place U.S. citizens on government kill lists.

Not only are there secret watch lists, but now there are secret kill lists. All which dodge the court system and any glimmer of constitutional due process.

My guess is that the US gov't has always had a targeted kill list. It's just being made public now.
