I don't know what constitutes malicious or reckless behavior in Illinois, but I don't see how consensual contact between 2 persons fits the description of either. Was it stupid? Certainly. Criminal? That seems a bit of a stretch to me. It's indeed sad that a young man lost his life over such a trifling event, but I really can't see how criminal prosecution is justified.
