Compromise? What kind of a compromise did WE meaning you and the LEO reach. Hmmm the LEO disarmed a legal gun owner, and forced you to stand there unarmed and defenseless until such time as the LEO determined that you were no threat, and for what? A broken tail light. POS if you ask me. No I am not bashing, but YOU did make the compromise, not the LEO, he took your gun, unloaded it, and then ORDERED you to not reload until clear of the area, well I say "F" that... That is an ILLEGAL order and you were not required to follow it. Please dont think I am bashing you, but YOU were the only one who was compromised...

BTW, don't worry, I reloaded before I left. I didn't fire any rounds into the air as I drove away though.....

I prefer the Freeman approach. To blow kissy faces at you guys when your fishing.:D

Not to thread high jack but fishing expeditions are not my thing. Ive spent to much time it class to give away my ninja secrets. Fishing trips are so mid 1990's

...........:n00b: Not an issue. TJ gave consent. Officer never said...well since you have a LTC im going to search your vehicle.

Again you do not need probably cause, reasonable suspicion....YOU NEED NOTHING TO ASK FOR CONSENT TO SEARCH.

Pirtle may come into play depending on where you work.

Fix the taped over tail lights and these things won't happen. Why let a potential equipment violation be the reason you get stopped and screw up a perfectly good wood cutting day. Assuming red tape was used so he couldn't give some BSD reason about visibility etc. to ticket you?

If your residence is here now why not simply get the Indiana permit and keep things as smooth as possible between you and LEO during potential encounters?

I know huh. IN is actually the ONLY state that recognizes all other states. In MN as liberal as they are, we're lucky we even got the permit to carry a pistol passed. We have to go through a full day of classroom with a skills test at the end just to apply for it, but no fingerprinting. I've noticed that fingerprinting is a big thing for many states reciprocity, a LOT of states will not even consider it with a state that doesn't require prints.

    Indiana requires prints.

The County Mounty involved here was clearly having a slow night and was most certainly on a fishing expedition. YOU might not do so, or say you do so, but this guy was clearly trying out for the Bass Pro Tour.

BTW, your constant statements about asking for consent makes me wonder about you saying "fishing expeditions are not my thing". Just sayin.

.... but what more could I really have done? I mean without being further inconvenienced without any real reason. I think it was sort of a compromise on my part but seriously who wants to stand in the cold with no more than a sweatshirt on any longer than I did? What says you?

You could have simply said no. I ask to search vehicles on a pretty regular basis. There's an "art," (pardon my coyness), to asking for consent into a vehicle when consent doesnt exist. Interacting with the public in such instances, is something that simply cannot be taught at the academy. That said, there have been plenty of times I've denied consent. I don't get butthurt, I don't try to get even, I simply conclude the traffic stop. Ive arrested people on consent searches when I honestly thought I wouldn't find anything (ie, I lacked the PC to search w/o consent), so the value in doing "random" consent searches is there.
My advice, know your rights. It's hard to place blame on LE for something you allow either because of your fear, ignorance, or indifference.

if you honestly didnt expect to find anything then why was you fishing? is that something you are trained to do? if you have rs or pc to search thats fine but otherwise why push the issue or are cops just nosy by nature?

Nosy by nature. Obviously, many people are not what they appear to be. I've learned the hard way that the black kid with saggy pants and gold teeth isnt always the bad guy. Conversely the white guy in the 3 piece suit driving a Lexus sometimes is.
Keep in mind, it's always your right to say "no." I ask, you respond, that's the end of it.

that is a fact. as the old saying goes you cant judge a book by its cover. strangely enough i have the same problem with leo i cant tell the good ones from the bad ones by looking. i guess its a burden we all share no matter who you are. if i give you consent to search my car and you give me consent to search your cruiser does that mean whoever finds the most contraband wins?

I usually stay out of these "Us vs Them" arguments but you make an excellent point! :yesway:

I dont think you asserted your rights at all. #1 thing I would have done different is not to tell him jack about whats in my car. #2 no cop is searching my car period. you got what you got because YOU allowed it. Som of you never cease to amaze me. you claim you want freedom, but yet you dont stand for anything. some people would and have faced death to defend freedoms, but some cant even tell a cop no, to do it. is there hope for America?

I don't have to fix it and am not going to spend money on this A-B beater just because it isn't pretty enough for him. My residence ISN'T here, it is in MN. I visit my wife here who is in the process of managing her uncles estate, until probate is closed we don't even own anything here while we DO own our house in MN (well, the bank does). Why would I spend the time, money and trouble to become a resident of IN for an undefined period of time only to turn around and become a resident of MN again when all is done here, especially since MN is my home? Do you know how much time and money and waiting is involved in getting my MN permit back if I did this?

So we're in agreement. Oh, and here's a clue in helping you tell the difference between "good" and "bad" LEOs. The "bad" one's won't ask to search your car, they'll pull PC magically out of their butt, and then sprinkle crack dust on your passenger's seat. :)
