New York's rush to pass a panoply of laws in the wake of NYSRPA v. Bruen last June has resulted in five significant federal lawsuits in New York. Several were decided at the District Court in favor of plaintiffs. New York appealed those. The others were appealed by plaintiffs. The five have been bundled together in one massive oral argument hearing before the 2nd Circuit Court of Appeals scheduled for Monday, 20 March, at 10 AM. Don't pin hopes on the 2nd Circuit 3-judge panel doing the right thing, even though the Bruen decision, its opinion, and its dicta were very clear. It's the same court from which Bruen went to SCOTUS. Either way, expect a motion to SCOTUS for a writ of Cert. In the meantime, all the preliminary injunctions were stayed by the 2nd Circuit allowing New York's Draconian laws to go forward. Request to SCOTUS for an emergency lifting of that stay had SCOTUS declining to act, but with a clear message to 2nd Circuit and plaintiffs to come back if 2nd Circuit didn't do The Right Thing.
