FOXNews.com - Arizona Governor Signs Controversial Immigration Bill

Arizona Gov. Jan Brewer on Friday signed a controversial bill that seeks to crack down on illegal immigration.
The sweeping measure will make it a crime under state law to be in the country illegally. It will also require local police officers to question people about their immigration status if there is reason to suspect they are in the country illegally.
Earlier, President Obama called the bill "misguided" and said it could violate people's civil rights. The bill's Republican sponsor, state Rep. Russell Pearce of Mesa, said Obama and other critics of the bill were "against law enforcement, our citizens and the rule of law."

I'm still waiting for Abdul, via his facebook page, to back up his ideas that this is somehow stepping on Federal law.

The Constitution never mentions immigration, so how is it that the rules for immigrants, and quotas from countries, are set by the federal government and not by the state governments? After all, as the 10th Amendment states, are the powers not delegated to the United States held by the states, or the people?

The Supreme Court has ruled that the Congressional power to regulate naturalization, in Article 1, Section 8, includes the power to regulate immigration. Key word here is IMMIGRATION.

Handling of illegals who are NOT going through immigration defaults as a STATE issue as I see it.

Nice idea! Let's hope the powers that be let this program work. ' Illegal ' means just that. Why are we even concerned with civil rights?

Why even call it an immigration bill?
    Immigration is just fine.

Immigration has nothing to do with the illegal entry and trespass of foreign nationals(criminals).

I really hate them illegals, and we need to run all illegals back to Mexico, but...

The law is likely unconstitutional as it violates separation of powers. The law places Arizona state courts as triers of fact on matters of federal law.

I don't think the law is unconstitutional.

    FTA:
The sweeping measure will make it a crime under state law to be in the country illegally. It will also require local police officers to question people about their immigration status if there is reason to suspect they are in the country illegally.

LEOs will still have to have probable cause to inspect papers; they aren't doing spot checks: "Papiere, bitte."

Why would Arizona, a sovereign state, not be allowed to enact law declaring that to be within its borders, one must be a legal resident of the United States? There's no conflict with federal law there; it only makes a state offense of what was once only a federal offense. And, as a border state, they have a much more tangible reason to be concerned with this issue than we do.

    This is a good thing.

Anyone see the television coverage of the near rioting in Phoenix?

It's nothing compared to Obama's whiny complaining about Arizona's law subverting other efforts to stem the flow of illegal immigration.

They simply put tighter restrictions on the federal law, which is what liberal anti gun advocates use to justify their obscene ant gun laws. We need to use their ideology against them more often.

I don't know if you recall, but a while back some African Americans who tried to attend a "white folks" college were also in violation of state law, and therefore criminals. Aren't you glad that we were concerned about those civil rights issues? This is the United States and being concerned with civil rights is what makes this country awesome. That's probably why they immigrate, legal or not.

    Civil rights?
    Seriously?
Illegal aliens are criminals plain and simple.
Criminal non citizens should not be afforded a claim to civil rights.
Nice red rep you got going there. Must be from gems like this one.

The only problem is going to be is the probable cause is going to be brown skin. They arent going to be asking for proof from white folks, so it's going to be a problem for sure.

Kidnapping Capital of the U.S.A. – Phoenix Arizona

    February 13, 2009 by national

Brian Ross and ABC News report what officials caution is now a dangerous and even deadly crime wave. Phoenix, Arizona has become the kidnapping capital of America, with more incidents than any other city in the world outside of Mexico City and over 370 cases last year alone. But local authorities say Washington, DC is too obsessed with al Qaeda terrorists to care about what is happening in their own backyard right now.

“We’re in the eye of the storm,” Phoenix Police Chief Andy Anderson told ABC News of the violent crimes and ruthless tactics spurred by Mexico’s drug cartels that have expanded business across the border. “If it doesn’t stop here, if we’re not able to fix it here and get it turned around, it will go across the nation,” he said.

California Attorney General Jerry Brown warned that as the U.S. government focuses so intently on Islamic extremist groups, other types of terrorists – those involved with the same kidnappings, extortion and drug cartels that are sweeping Phoenix – are overlooked.

“Those [criminals], for the average Californian or the average America, may be a more immediate threat to their well being,” Brown said.
In fact, kidnappings and other crimes connected to the Mexican drug cartels are quickly spreading across the border, from Texas to California. The majority of the victims are either illegal aliens or connected to the drug trade.
An ABC News’ investigation uncovered horrific cases of chopped-off hands, legs and heads when a victim’s family doesn’t pay up fast enough.

Come on Panama don't be pointing out that Arizona had little choice.

They felt they had to do something to protect the citizens of the State. Kidnappings, rapes, murders going on at the hands of illegals are not going to make a politician popular with the voters if they do nothing about it. Sure the Federal government should be responsible for safeguarding the borders of this country, but if they are going to shirk their duties can you blame a State for filling the void. The only answer the Democrats have is to praise the gallantry of the illegals and try to give them amnesty. It seems the only answer the National GOP has is to look at their shoes and hope the problem goes away.

Unfortunately for your argument, rights to man are only granted by God. Not affording rights to any one person, regardless of that person's citizenship, immigrant status, or individual criminal culpability; smacks of a profound disrespect for His word.

The rights of man by God, is also the concept envisioned by the authors of our current form of government: The Constitution.

I empathize with your feelings of illegal immigration. However, when any people, or class of people, are denied their rights; look out. Your rights are the next to go.
