This was mentioned in the healthcare bill passes thread, but seemed to pass with no real comment. The House passed bill contains provisions for the fining and imprisonment of people who choose not to participate in this intolerable act. The fines will be large and imprisonment can last for many years. All for choosing to not participate in an unconstitutional act, (some form of which will be passed). The government will use the IRS as an enforcement arm, and quite likely use their courts, rather than your local courts. We can also speculate that there will be other penalties, as well. I can see that you could easily be accused of child abuse and, as a criminal and scofflaw, have your children stolen from you by the state. That would likely happen once they sent you to prison anyway, or bankrupted you with their fines or expensive insurance policies.
So where does that leave you? Vote people out? Unlikely. The most liberal of the progressives are in truly safe districts. Most of the so-called blue dogs are in safe districts, too. Sending letters, calling and emailing didn't seem to work out too well, did it? Will it work with the senate? I'm not holding my breath. They will pass something and it will likely contain penalties for disobedience, too. Otherwise, what's the point? This entire issue is putting our backs to the wall. Is this our intolerable act?
JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail
    Friday, November 06, 2009

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”
Key excerpts from the JCT letter appear below:
H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

    - - - - - - - - - -

If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

    Criminal penalties
Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:
    • Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
    • Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]
When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.
“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.
According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

David Codrea also brings up the fact that you'll lose your 2nd Amendment rights, too.

    Here's what they claim:
JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail...Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.”
If that's true, we need to look at U.S. Code, TITLE 18, PART I, CHAPTER 44, § 922, where we find:
    (g) It shall be unlawful for any person—
    (1) who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year...to...possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.

Nice way to do a passive revolt. 100,000 new prisoners because of this would overwhelm an already overburdened penal system. 1,000,000 new prisoners? Can you imagine the benefits for all those prisoners? Free education, room, board, oh, and don't forget HEALTH CARE!

Also, the penalty for non-compliance is 2.5% of your income (seen in another thread) so I will just cut the check for 2.5%, and still not get their healthcare coverage. Oh, wait, what a thought! Could it be that this is the REAL goal?

In any case, this will NOT work out the way they are planning...

Jake Tapper interviewed Obama and the subject of penalising and imprisoning people came up. Obama has no problem with sending people to prison for refusing to participate in his scam.
    From ABC

During an exclusive interview with ABC News’ Jake Tapper today, President Obama said that penalties are appropriate for people who try to “free ride” the health care system but stopped short of endorsing the threat of jail time for those who refuse to pay a fine for not having insurance.
“What I think is appropriate is that in the same way that everybody has to get auto insurance and if you don't, you're subject to some penalty, that in this situation, if you have the ability to buy insurance, it's affordable and you choose not to do so, forcing you and me and everybody else to subsidize you, you know, there's a thousand dollar hidden tax that families all across America are -- are burdened by because of the fact that people don't have health insurance, you know, there's nothing wrong with a penalty.”
