Calif. bans open carry of shotguns, rifles - UPI.com

The Los Angeles Times said the bill was inspired in part by recent actions by gun-rights advocates who entered coffee shops and other places carrying rifles as a demonstration of their right to bear arms.

Brown also signed a bill allowing movie and television producers to use working sawed-off shotguns as props while filming in the state. Such weapons are banned in California.
So OC in any shape or form is now illegal, unless you are a Hollyweirdo OC-ing a sawed off shotgun for a movie... Some pigs are more equal than others... :xmad: :xmad: :xmad:

    Where's the bacon?
Interestingly enough, the reason people were OCing long guns into those places is because CA first strictly limited the issue of permits to carry handguns, then outlawed the carry of a loaded handgun without a permit, then the carry of an unloaded handgun without a permit. What did people have left available to them to lawfully carry for their own defense?

Some frogs just don't want to be boiled.

    Blessings,
    Bill

This is not an all bad situation. It now opens the door to court cases suing the state for violating the peoples Constitutional right to carry. It's virtually impossible to get a CC permit in California and now, with open carry in any form outlawed, there is no longer a right to bear arms in the state. My guess is that the folks at the SAF are already getting their cases together. The NRA will likely come along after all the real ground work has been done.

Oh, noes, they threw us in the briar patch.:D

Federal courts no longer have the out of saying that "well, you can always open carry unloaded guns".

A flat ban is what we need.

This isn't surprising. Sometimes we are better off if people stay off there soap boxes.

Boom! I knew those idiots in California were going to lose their rights after other idiots "trying to prove a point," (ie CopBlock-esqe types) started posting "gotcha" moments w/police on youtube. Now, a right that HAD existed (even in California) is gone to them.

I'll be baffled if it's overturned. They may admonish California concerning the issuance of permits, but it's doubtful they'll strike down the law. And this is assuming it ever gets to the USSC.

They may seek to overturn the no open carry laws (initially brought about by Reagan), but it's more likely that they'll try to force the state to become Shall Issue, where permits are concerned. That's the likeliest strategy. After that they can go after Constitutional carry.

Lose what rights? They barely had anything to begin with.

Should it be be a Federal decision or a State decision?

    Federal.

The prior lawsuit was in federal district court and the judge ruled that since California allowed for the open carry of unloaded guns the right to bear arms was not impacted.

As you know there is no state RKBA provision in California's Constitution.

Do not doubt. The Supreme Court has discussed the right to carry a gun outside the home in both Heller and McDonald.

The federal district court ruled that the state can pick one method to ban--concealed or open but not both which is consistent with time, manner, place restrictions that will likely be held constitutional as in the First Amendment.

Commie-formia has never had the RKBA enshrined in their state Constitution. Relief would have to come from SCOTUS.

They knew full well when they became a state, that in the United States, we have the right to keep AND BEAR arms. The Feds need to tell the state to pound sand and give their citizens rights.

The state cannot grant rights, only privileges. The people in Cali already have the right to keep and bear arms, they've just been convinced by the politicians, judges and lawyers that it ain't so. I lived out in the bay area for almost a year and carried all the time. Never had a problem. Didn't ask. Didn't tell.
