Each candidate has to petition for placement on the ballot, doesn't he?
If they do that they can only run as "independents" in certain races. The Constitution Party does not have ballot access in the state of Indiana. They have a lot of work ahead of them to gain it.

    That sux.

But you said "if they do that." What would the alternative be? I'm just not familiar enough with the election rules and regs, particularly when it comes to third parties.

Their only alternative is to gain ballot access. That takes a lot of hard work, money and petitioning. The LPIN managed to do it back in the 90's and has maintained their access ever since. It takes an organisation and boots on the ground, (not to mention loads of paid petitioners statewide). After that it takes people willing to run for office on different levels during the elections. You have to have a Secretary of State candidate and they have to garner at least 2% of the vote in the election to maintain ballot access. There are perks in getting higher vote percentages, since you gain major party status and you get people appointed to certain positions. Running as independents gains their party nothing and they will not be recognised as members of that party. Plus the petitioning can be fierce and it's easy to screw it up.

Even having a vague understanding of election laws, it is evident that the deck is stacked incredibly in favor of the R's & D's. Democracy is neutered this way.
