    *maybe.

I release guns without court orders fairly routinely. Circumstances matter.

Does this not come back to the same issue? There are no real "rules" that are followed in returning an individuals confiscated firearm, it is always subject to a department's/LEO's opinion of the matter?

What about other LEO's in your position? Do they use the same criteria as you for releasing confiscated weapons?

It's just a check box form for us. If it's done at the lab I get a form. If there's no court pending, it's released. To continue the hold you list the next court date.

A little OT but aren't some of the newbs a little off base lately?

[edit] Just went back and looked and some of these folks aren't even newbs.

Thanks I don't need to know what it's called or read IC that's what attorneys are paid for

You are very welcome, and I do indeed get paid very well. I'll send you my bill. :D

But in all seriousness, my post was not necessarily to you specifically, but to anyone reading this thread who would rather look into it themselves to see what is involved and maybe not have to pay for my services.
