    I get it, but that has nothing to do with expungement.

    I can say that Rittenhouse killed 2 people, was arrested and tried for intentional homicide all day long...and I am 100% right. The defamation is not being accused of a crime, it's attributing motives, beliefs or actions to him that are untrue.

    What's more, even if someone is arrested and convicted, and then has it all expunged, it's not defamation to say that a guy was arrested and convicted of a crime.
