I think where it breaks down is asking the black guy to leave the pool area even after he tells you he lives there. Assuming he's lying gets REALLY close to your second example, especially if the person asking doesn't ask any of the white people that they don't recognize to leave.
Even in your first example, asking the black guy to leave is malicious, even if not intentionally malicious. The asker may not mean any malice to the black guy, but they want him to leave. Because he "looks" like he "doesn't belong."
That's a very narrow gray line between your examples. IMHO.
