    I have never used any pre-exit tests nor was I ever trained on them. I use pre exit behavior observations along with SFSTs and sometimes PBT results to build my PC.

    I dont get why I should erase my post. This is what happened. What does it matter if anyone sees it. I dont anticipate being reimbursed for a damn thing. The part that I find most upsetting is that the Tribune wont do a retraction to my name being in the column of local arrests. Anyone who reads that and sees my name will assume I was drinking and driving.

    I will say this, if I heard this story I would totally call BS. The fact is that I was nervous when he put me in his car. Not about jail, but the trooper had been acting so crazy I was actually worried about my safety.

    They're giving you good advice. You're basically "showing your hand." A good pros will use this against you if they get their hands on it.

    For instance, you make reference to your wife filming the incident. Ok, you just indicated something that someone is going to want. I imagine that some slick willie is going to be asking you about that vid, and wanting to list it in discovery. You don't have it? Well why not? Is there something that you "don't" want anyone to see?

    Coming from someone who has NEVER drank in my life. I understand your concern and nervousness you felt. Most people who are upstanding, law abiding citizens don't think this could ever happen to them.

    I have had one incident where a young cop 'on a power trip' accused me of drinking. It was late and was out shopping. I like shopping late to avoid the crowds.

    He pulled me from the vehicle and asked a 'total' of three times (during the stop), if I had been drinking. He finally sent me on my way. He is now employed else where.

    If the facts of the story are true, I'd not stop until I was satisfied with the outcome.

    The second cop shining his light at the phone, well, I have thoughts on this, but won't post them. Lets just say, not their first rodeo.

    I do wish you the best. There are so many wrongs to this train of events to even try and defend their actions. I think THEY must have been outside drinking to think what they did was the right course of action.

    Another thought: Maybe their dash cams have the officer pulling your wallet from your pocket?

    I want to hear you opinion, if you don't mind, and wont violate any TOU. Personally, I think you are looking at it from one perspective. Unless, I can see the video (and this isn't to say the officer wasn't doing what the OP said), I can think of other reasons why it might not have been what it appeared to be to the OP.

    Standardized field sobriety tests do not include any alphabet or counting backwards. they only involve nystagmus (eyes) walking and counting your steps, and standing with one foot raised while counting aloud. they are not designed for amusement and are pretty good indicators for officers who know how to administer and interpret them.

    1. I know that you don't believe that telling the truth won't be of detriment. However, the justice system isn't about truth. Its about procedure. The other side won't open their mouths about anything until they are under oath, so its best that you don't either. Hence, its in your best interest to edit the OP.

    2. Your attorney should immediately contact the ISP Office of Professional Standards. If this joker has done this to you, he has certainly done it to others.

    whocares, I care and I am also from the New Albany area.
    OK, it seems driving without a license was wrong only if you knew it was suspended. Throwing a lit butt out the window was wrong, but this trooper and his backup needs to be fired for this.

    These are the kind of guys that don't understand why we pay them.
    Go talk to the owner of Triple G in Greenville and see if he has any suggestions. He is an ex-Trooper and a good man. He might even know this Trooper Davis.

    I've never talked to him about legal issues, but I do know he's a man who knows his :poop:. He may not be able to personally help you, but I'm sure he can point you in the right direction with a few names.

    Lawyer up like yesterday, make copies of the cell phone media, hold on to that breathalyzer tip. Push the case quick before all media from the cops dash cams are purged. A good lawyer who sees a very winnable case might do it pro bono.

    IMO you need to take INGO's advice on this and delete this post and lawyer up... but if you don't care and are going to leave this up for all to see, you might as well go ahead and upload the cell phone footage and let INGO have a look at it.

    Deleting it only erases the immediate "user level viewing", and encourages questions of "why did you delete it"?

    Lawyer up and make sure they know this post is out here (public forum) so they can mitigate things correctly.

    Just reading this is enough to send my BP up. I hate to hear this happen to you and your wife. Cops like this give the rest a bad name.

    If this happened the way you say, this cop should be thrown off of the force, and be made to reimberse you for all your expense and trouble. I hope this turns out well for you and yours.

    Google and Microsoft crawl INGO on an almost continuous basis. Any post is indexed almost immediately and will generally show up in their search results in under five minutes. The best advice is to not post anything about a pending case. Why would you, unless you're trying to garner public support? Shut the hell up and call your lawyer. I guarantee you that his lawyer is going to tell him to ask the mods to delete this thread (even though it will be pointless at this point). Well, now he's got his pats on the back from INGO and everyone has told him how right he is and how wrong the cops are, and incidentally also seriously damaged his case with his full written confession on a public internet site. :rolleyes:

    When I was taking flying lessons, I was taught a lesson that really stuck with me. If you ever violate a regulation and are asked to phone the tower when you land, never say "sorry". That one little word is an admission of guilt. One word. It doesn't matter if you were right or wrong, you just lost your pilot's license and you caught a hefty fine. Shut your trap and call your lawyer. Let your lawyer post about it if necessary.

    Don't EVER, EVER, EVER, EVER talk about ANY open case unless it's with your lawyer or its a very general discussion (no specific details of any particular incident). Everybody had good advice but you ignored it and screwed yourself futher...

    Time for learning :)

    1) Don't get out of your vehicle unless they have weapons or have given a reason to detaining you.

    2) Don't carry all your important info in your wallet, and not copies.

    3) Lock your own car if you are ever detained or asked to step out, make sure windows are up. Turn the key to accessory and roll em up.

    4) If you are sober, refuse field sobriety and just go with the blood draw. Since, the test is not standardized go with something that is. The questions aren't about your ability to do something, it's about being able to follow directions with more than one step.

    5) Buy an audio recorder

    6) Quit smoking

    7) Never assume anything.

    For clarification on refusing sobriety checks: do you lose your license for a year if you fail to submit to breathalyzer but not field sobriety? I didn't realize the latter was "refusable". Are there ramifications to that?

    When we have patients brought in for a blood draw to the ED our first goal is to get them out of there so the police aren't wasting their time babysitting a drunk guy. I don't recall them ever bringing someone in that wasn't clearly intoxicated on something, whether alcohol or drugs. They are generally there under 30 minutes and never get a result before they leave. Typically police will leave with the vial and run it through their chain of custody rather than ours.

    It's been said many, many times. Get a lawyer. Contact a lawyer recommended by someone you trust and explain the situation. You are not the only person who has ever dealt with this, so a lawyer who does this kind of work will have options for payment.

    People think they can navigate this course themselves and on rare occasions, they can. Hopefully, this will demonstrate how important it is to get a lawyer: I am a lawyer with 15 years of experience and the highest ratings there are and I would never even consider representing myself because I do not do this kind of work. I would hire an experienced criminal defense lawyer.
