    That's happened twice. First time, I bought a cart full of drinks. Door greeter asked to see my receipt. I said no, but thanks for asking and walked out.

    Second time, bought a pellet gun for my son. The cashier forgot to deactivate the tag and it set the alarm off. I didn't miss a step as the door greeter ran behind me, trying to tell me it was the law that I had to stop. My daughter asked, "is someone looking for a lawsuit?" I said, "it looks that way". That stopped him dead in his tracks.

    Can't remember if my I told this story or not so I'll tell it again:

    My wife went to Wal Mart during christmas shopping season one year to get a new computer for my boys. She got the computer and a printer for herself. She went to the U-scan, paid for the stuff, and stacked it in her cart. She was right next to the door when checking out. After she paid, she stuffed the receipt into her purse and walked towards the door. As she was nearing the 'beeper detector' the greeter asked to see her receipt, to which she replied "maybe next time" and kept walking.

    Our philosophy is to not show or provide a receipt when asked. I paid for my merchandise and my interaction with the company ends there. It is my merchandise. Should they choose to follow me out of the store or detain me in any way, they better darn well be able to prove beyond a reasonable guess that I stole something.

    I remember back when I worked at walmart thiefs used to stuff DVDs and other things inside of a larger boxed item that they purchased ( i.e. a computer) in order to get by store security.

    Yeah, checking out the packing tape would be a good 'tell'... and the 'theif beeper' going off :D

    Checking my receipt for stuff in my cart against my receipt, would not reveal things stuffed in a larger 'paid for' box :dunno:

    When my wife worked at Kmart, she said people used to walk out with stuff all the time.

    Worked as a floor detective for 10 years part-time... your friend experienced a false "arrest" and the store and individuals making the stop could be sued. I worked for JC Penney and LS Ayres among others and all Owners were insistent that we error on the side of caution....if there was any doubt of a shoplift, let the suspect go.....not worthe the liability and publicity. If I were your friend, I would have stood my ground outside and called 911 or asked someone to call 911...get the duly authorized authority on-site. you do not have to go forcibly anywhere with a private citizen.

    You need to review that policy. At 120 minutes your authority to detain is over, regardless of if the police are on the way or not. I've already posted the relevant IC code earlier in this thread.

    You've got their info, cut them loose, we'll file a warrant for them.

    I escorted my wife to a Michaels tonight and noticed a new display with a blinking light that said below it, "You're on camera." Sad state of affairs where we're all treated like criminals.

    P.S. I had a gang banger outside drive by me and point his finger at me like it was a gun and smile. Another sad state of affairs.

    I have issues with the way your friend was treated, but I want to go in another direction...after he gets done with his attorney I would recommend a situational awareness class. I agree that without all the facts we can't say what we would have done, I would want to think that I would see 2 guys barreling down on me and reacted in such a way that I would not have been thrown against a wall.

    Late to the party here, but with 15+ years in the industry I just gotta weigh in here.

    First, he didn't have stolen merchandise, it's what we call a bad stop, the store, and the individual employees are now open to serious civil liability.

    The security officers are also guilty of Class D Felony Criminal Confinement:

    IC 35-42-3-3
    Criminal confinement
    Sec. 3. (a) A person who knowingly or intentionally:
    (1) confines another person without the other person's consent; or
    (2) removes another person, by fraud, enticement, force, or threat of force, from one (1) place to another;
    commits criminal confinement. Except as provided in subsection (b), the offense of criminal confinement is a Class D felony.
    (b) The offense of criminal confinement defined in subsection (a) is:
    (1) a Class C felony if:
    (A) the person confined or removed is less than fourteen (14) years of age and is not the confining or removing person's child;
    (B) it is committed by using a vehicle; or
    (C) it results in bodily injury to a person other than the confining or removing person; and
    (2) a Class B felony if it:
    (A) is committed while armed with a deadly weapon;
    (B) results in serious bodily injury to a person other than the confining or removing person; or
    (C) is committed on an aircraft.
    Your friend needs a lawyer ASAP. He also needs to IMMEDIATELY contact the prosecutors office where it occurred and press criminal charges against the two security guys.

    In indiana if a non police officer cuffs you without it being a felony it is wrongful imprisonment/kidnapping/ etc.....SUE THEM! The store and the security company.....

    Let me rephrase this...IF... In indiana if a non police officer cuffs you and you end up being found not guilty.. it is wrongful imprisonment/kidnapping/ etc, and they can be sued.

    I was security for a retail store for over 3 years. First of all they should have identified themselves by badge and verbally. The security also should not have made physical contact for a pen! Your friend could sue them for harassment and believe it or not he would win.
