    Ok I was recently told it may be illegal to carry at the state fair. Can anyone help shed light on this?
    My thoughts are
    1 we regularly have guns on fair property during 1500 so?
    2 I really don't like locking my gun in the car for hours especially with the number of cars broken into.
    Is it legal as long as I keep it concealed and keep my mouth shut?

    The following is a list of places that are off-limits when carrying a concealed weapon in Indiana:
    • In or On School Property.
    • On a school bus
    • In or on property that is being used by a school for a school function
    • Private School(IC 20*9.1*1*3) & (IC 35*41*1*24.7)
    • Head Start (IC 35*41*1*24.7)
    • Preschool (IC 35-41-1-24.7)
    • IC 35*47*9*1Allows the carry of firearms by persons permitted to possess and who are transporting a person to or from school or a school function.
    • On an aircraft
    • Controlled access areas of an airport
    • During annual State Fair 80 IAC 4-4-4 (Must lock in vehicle)

    Not sure what false information your referring to, but here's the actual wording of the law:

    80 IAC 4-4-4 Deadly weapons prohibited
    Authority: IC 15-13-2-9
    Affected: IC 15-13-2; IC 15-13-7

    Sec. 4. (a) This rule does not apply to a federal, state, or local law enforcement officer or to a person who has been employedor authorized by the state fair commission to provide security protection and services during the annual state fair.
    (b) No person in possession of a deadly weapon shall be permitted onto or be permitted to remain on the fairgrounds duringthe annual state fair.
    (c) Any deadly weapon found in the possession of a person while on the fairgrounds during the annual state fair is subjectto immediate confiscation by law enforcement officers or other persons authorized by the executive director of the state faircommission.
    (d) Any person properly licensed to carry a firearm must secure the firearm in a locked compartment of his or her vehicle,and it shall not be visible to passersby.     Sorry, misread your post. I thought you mentioned something about being "criminal". I apologize, I misread that. But still, they only set you on fire when you carry there. No real criminal penalties that I see listed.

    I would question what "confiscation" means to them. Is this a "confiscated until you leave" confiscated, or is this a "pocket knife you forgot about in your pocket at the city/county building" (i.e. ours forever) confiscation.

    As for setting you on fire, they have to drag you to one of the designated smoking areas first.

    I retired in 2014, so things may be different now.

    I've yet to hear of anyone having anything confiscated at all - only people being escorted out/off property.

    The IAC statute is so poorly written/incomplete/etc that a Trooper/C.O. who did confiscate could easily land himself/herself and their department in some legal hot water.

    If there's going to be a law/statute it needs to be complete. Of course, this statute is asinine to begin with so I'd rather it be off the books totally...

    The authority to implement this is also defined in IC 15-13-2

    Chapter 2. State Fair Commission
    IC 15-13-2-1
    State fair commission established
    Sec. 1. (a) The state fair commission is established.
    (b) The commission:
    (1) is a separate body, corporate and politic;
    (2) is not a state agency; and
    (3) performs essential governmental functions.
    As added by P.L.2-2008, SEC.4.

    Interestingly enough, it specifically states the Commission is not a State Agency, exempting it from the firearms preemption law. At the same time it also calls the Commission into existence through state statute "to perform essential government functions", which by any reasonable interpretation would make it a state agency.

    Another one of those firearms laws that doesn't really make sense and does nothing to make people safer. Maybe one of our resident legislators can work toward getting this limitation removed...
