Who would sue such a fine gunshop.

They say records from the U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) show that between 1996 and 2000, KS&E ranked 34th in the nation in sales of guns later used in crimes, selling 529 crime guns in that period.

I'm not disputing that their clientele is the greatest but the problem I see is unless it is a blatant straw purchase and you knowingly allowed it then it's just a statistic that someone threw together. Once someone makes that purchase and walks out the door, you can't control what they do with the firearm after that. If they were blatantly allowing straw sales, I would venture to say that the ATF would of already set them up and shut them down. They are also basing it on records that haven't been updated in 13 years. So 13 years ago they ranked in the nation. How about the last 13 years? Did it go up or down? Apparently, there are no new stats to answer that.

These stats the Brady center is using also rank Don's guns up near the top. Why didn't they sue him too. I'm sure a few of the guns he sold committed crimes on their own too. LOL

Have you ever been to their shop? Do you know the kind of neighborhood it's in? Statistically speaking it's HIGHLY likely that they're going to get the type of customer that may use one of their guns in a crime.

    Also from the article:
"The Brady Center says KS&E made no effort to find out who was the actual buyer." If the buyer filled out the 4473, then they did all that is required of them by law. If the buyer lied on the form, how would they know? What's next, polygraphs in order to buy a gun? I don't think the Brady Bunch has a leg to stand on, but IANAL.

You're looking at the wrong picture here people. It isn't about gun shops selling guns at all. It's a lot worse than that. It's about driving them out of business with frivolous lawsuits. Drag a gun shop to court enough , they'll go broke trying to defend themselves . No money, no gun store. Guys like Bloomberg and company supply Brady with a lot
more money than any gun store could ever have.

According to Gary Kleck (criminologist & author of "point blank--guns and violence in America"; 1989) one problem of relying exclusively on FBI 'uniform crime stats' is that they list actions as they're INITIALLY listed by the local authorities. So, if you're a neighborhood crime watch captain who is attacked by someone that you called the police on and you are charged with murder after shooting him in self defense, that goes into the FBIs 'UCS' as a murder without regard to the final verdict.
I wonder if there are any jurisdictions that require the plaintiff to pay the defendant's legal fees if they lose?

So, why not sue the guy that bought the gun and sold it to the shooter?
oh yeah, probably because he has no money, and it wouldn't make the news. Or possibly shut down a gun shop!

Those neighborhoods shouldn't be allowed the second amendment.
