I have heard of this challenge in a couple states. Great idea, but someone is going to spend some time in the Federal pokey before it ever challenged in court and decided. That is if the courts will even hear the argument.

You do know why they call it the pokey don't you?

I think I will settle for MADE IN USA on my NFA guns.

I think it's because the time goes really slow.

I will be astonished if this law works out in any way.

After posting the above I recieved this message, I post it for your consideration.

    "Corey,

    Greetings from Montana.

I read the post on ingunowners.com about the Montana Firearms Freedom
Act. FYI, I wrote the MFFA. It declares that any firearms made and
retained in Montana are not subject to any federal authority under
the power of Congress to regulate commerce "among the states
..." When I wrote the MFFA, I excluded full-autos from the effect of
the act because I didn't want machineguns to be a distracting part of
the political or legal debate over the measure. Suppressors are not
excluded, nor are short-barreled arms. Crew-served arms are also
    excluded, as are exploding projectiles.

The MFFA became effective in Montana on October 1st. The same day,
MSSA filed a long prepared lawsuit as a civil matter in federal court
to validate the principles of the MFFA, specifically so that no
Montana citizen must face possible federal prison time to test this
Montana law. We're asking for a declaratory judgment and injunctive relief.

Meanwhile, a clone of the MFFA has been enacted in Tennessee, and
other clones have been introduced in AK, TX, FL, SC, PA, MI, and
MN. Legislators from about 20 other states have contacted me to tell
me that they will introduce clones in their states as soon as their
legislatures reconvene. I'm pooling information about the FFA movement at:
    http://firearmsfreedomact.com

President John Kennedy said, "Those who make peaceful revolution
impossible will make violent revolution inevitable." The MFFA and
our lawsuit is our attempt at a peaceful revolution. We'll see how
    the federal judiciary treats this.

    Best wishes,

    Gary Marbut, president
    Montana Shooting Sports Association

P.S., you may post this at ingunowners if you wish. I didn't join
because I didn't want to have my 437th login and password to remember. "

    SWEET! :rockwoot:

I had heard about this elsewhere awhile ago but it had slipped into the nether regions of my mind. I think I saw Mr. Marbut and some of the politicians involved on Glenn Beck awhile back. This is something we Hoosiers should look into for ourselves with great interest for sure.

Well I'd be waiting this one out until decided in federal courts. Too much potential for trouble. Pokey doesn't sound fun at all.

Well I was discussing this with a friend at lunch. He knows nothing about guns but brought up another point. Didn't the DEA a few years ago executed search warrants and confiscated a whole bunch of pot in California from state licensed growers/vendors. I don't know any specifics but I could see parallels start happening

The DEA was doing that up through the last month, not just years ago. It was clearly a violation of the 10th amendment, but no-one from the state police to the local sheriffs would stop them. Quite the opposite, in fact. They joyfully joined the DEA in their crimes. Busting legal storefronts that were selling a legal medical substance. Of course, we now have Obama's word that he's not going to do that anymore, with some caveats, of course.

    did anyone read this

    Exceptions

However, this law does not apply to a firearm that cannot be carried and used by one person, a firearm that has a bore diameter greater than 1½ inches and uses smokeless powder, ammunition that uses exploding projectiles or fully automatic firearms.

the author of the ligslation said that autos were purposely left out so as to make the bill less debatable on it's "evil" merits. IOW, he didn't want it to turn into solely a debate on machineguns

Smart... He knows this would be a huge win for the 10th and didn't want full-auto to kill it.

However if you eat an elephant 1 bite @ at time by the time you get to the end the meat will be rotten since you took so long.

Best to SHARE that elephant and allowed all the states to eat various parts of the elephant instead. :D

You cannot force someone to eat something they don't want to eat. While each state undoubtedly has citizens who would like full-autos without the worry of tax stamps and 5-figure costs, their individual legislatures do not necessarily have so-called representatives who recognize liberty when they see it. Too, some, I'm sure, are waiting for Montana to fight the fight, then will follow their lead.

    Blessings,
    Bill
