Generally for the privileged and/or those with enough cash to afford a very good lawyer. It's not that uncommon for it to happen. Heck sometimes they just get a stay for a number of day to "get their affairs in order" before they are required to actually serve their time even if they aren't appealing.

It's worth a watch IMO but here's a TL;DW synopsis.
Nate breaks down Smollett's attorney's main appeal argument in which they claim that he never should have been charged again and convicted based on the rule of double jeopardy because of the previous deal that was given to him by the Cook County SA office under Foxx's direction. The sweetheart deal was designed to make Smollett's troubles all go away.
The problem with that is since Cook County DA Kim Foxx recused herself neither she nor HER office which she is in charge of had the authority to offer that deal and a special independent prosecutor outside of HER office should've been appointed by a judge to prosecute the case.
Foxx took it upon herself to bypass that process and assign an ADA from HER office to handle the case and offer the sweetheart deal to get Smollett off the hook which again she nor HER office had any authority to do so once she recused herself.
KIm Foxx is corrupt as hell and should be facing ethics charges for her shenanigans in the Smollett case.
Depends. What was the crime, who is your attorney, who are you, likelyhood of the appeal being upheld,... Mainly the second two.Was he given special treatment or it is normal for bail to be granted while waiting on an appeal?
