    Since the big O has declared a "state of emergency" due to H1N1, what does that do to the normal constitutional channels of getting things done?

    Ergo: What powers does he now have that may subvert congress?

    Can he say: Make a treaty without without it having to be ratified?

    He cannot subvert the Senate to ratify any treaties. Especially the anti-gun treaty I'm sure you have in mind.
