Who profread the ToS for INGOGear?

Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of INGO Gear products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of INGO Gear products) must be commenced within one (1) year after the claim or cause of action arises. INGO Gear's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. INGO Gear may assign its rights and duties under this Agreement to any party at any time without notice to you.

On a side note.. all those Terms of Service for software you install or websites you visit.. they are valid in courts. Yes, they may be many many many pages long, but it couldn't hurt to read them over to make sure that you aren't selling off your first born just to look at funny pictures of cats.

So Ingo is hosted in Florida and Ingo Gear in California? :dunno:

Not sure. the WHOIS for ingogear.com says it's a Volusion site. Volusion is headquartered in TX but may handle their server farms out of CA. Most of their leadership board has CA roots.

    Volusion Review Unbiased User Reviews

It appears Volusion uses RackSpace for the actual servers, but not sure where the farms are for that, though some sites say it's CA.

When I do a tracert to ingogear.com (192.240.51.246), it gets to CA and then fizzles out every time.
