    I wish this always happened. I have been very against posting mugshots in print or online before convicted. They have the person no reason to share until it is a done deal. They post the mugshot… charges get dropped / mistake whatever they never post a revision.

    Right? The Northwest Indiana Times posts those mugshots all the time and I always wonder if these people have any legal recourse if found not guilty.

    I look at the mugshots to see how much older everyone looks than I do.

    But as long as they are only posting what they are arrested for and they were in fact arrested- that is truthful and while anyone can sue for anything, it's not a good suit. Being arrested and being convicted of a crime are two vastly different things.

    I agree but to me it goes against the “innocent until proven guilty” and the people are guilty in the “public eye”

    Admittedly ridiculous hypothetical here. Bob and Cletus look very similar. Live in the same general area, maybe drive similar/same vehicle. Cletus takes the phrase "**** them kids" too literally but Bob gets arrested for it in a case of mistaken identity. Times posts Bob's mugshot with the diddling kids charge. Bob is found not guilty/case is dropped because they found out Cletus is the creep. In the meantime Bob's been fired from his job or his business lost customers because "newspaper said you're a kid ****er" His livelihood is ruined.


    You as a lawyer aren't going to even take a look at a case for defamation or something?


    In that case I wouldn't even blame Bob for making a sequel to the Killdozer.

    If the newspaper accused him of being a child molester- sure. If the newspaper stated that he was arrested and charged with child molesting- no.

    There is a possible cause against police and prosecution depending upon what they knew and when they knew it. It's a tough case and more than negligence has to be proven.

    Early 70's I shared a House with 3 other guys. One had the Same Name as a local Bad Guy. He was mistaken by Law Enforcement several times.
    I share a name with a bad guy a couple towns over.

    It's never ended badly for me, but I've had two different cops do a double take when looking at my license. They had previously had run ins with the other ghuns. Got off with a warning both times. :D

    I'm on probation in the next county over, and I ain't never been there.
