I won't comment on YOUR particular situation,
But I've owned several pieces of property, and in every single case if a pole was needed off the right of way, the property owner had to pay for it and it belonged to the property owner.
Placement/Replacement is entirely at the expense of the property owner should something happen.
Ask anyone that's had electric service run to a lot for mobile home, for instance.
You more than likely own the pole and can do with it what you like...
