    I'm inside my house, about to hop in the shower and I see someone going through my trash cans. So I go outside, slide my shirt up, unsap my holster and have my hand on my weapon. I ask if I can help them and he tells me that he is a sherrif deputy and to take my hand off my weapon. I asked for ID so he showed me ID. I asked why he was going through my trash. He told me

    your credit card issuer reported that I had bought sudafed and paint thinner. I said yes, so why are you looking through my trash.

    He responded it's protocal. I asked if he had a search warrant and he said he did not. Then I told him I am painting my basement floor and I have allergies and he would be more than welcome to come back and look through my trash and I'll show him the basement with all other supplies if he got a warrant. He then left.

    I'm pissed. I just paid off the credit card in full, called my issuer and told them to **** of and cancel my account.

    Do I have any legal ramifications against my credit card issuer and the sherrif department for going through my trash without a warrant?

    Only if your trash was locked up inside a building. Once it's out in public view, even on your property, it's fair game.

    Somewhere in the list of terms and conditions you agreed to in order to have a credit card your issuer probably included something to the effect they can share your purchasing history with anyone or no one they choose to. Honestly not worth the pissing match. You'll lose. Tear up the card and make sure your other card issuers don't do the same thing.

    What are the privacy policies associated with your credit card provider?

    If they violated a written policy then I would seek out an attorney and have them held responsible.

    Stuff could have gotten very real for that breach of privacy. :twocents:

    The credit card company reported you? I didn't hear about any requirement for them to report purchases. It may be in all of the fine print, but it seems like that's something they would be made to make clear, similar to the interest rate.

    Check your credit card privacy statement to find out if they reserve the right to report so-called suspicious activities.

    hmmmmmmm. banks and merchants reporting purchases and deposits on its customers to the government and law enforcement. then LE coming and going through your trash on circumstantial evidence.

    but we dont live in a police state. nope, sure we dont.

    I really don't think this is gonna be a battle I'm going to fight in the court. Best case scenario would be a settlement but also signing a legal doc to never mention it to anyone. Best thing I can do now is spread the word of how evil that company is.

    i hope you file a complaint report with the sherrifs office at least.

    i would have told him im not taking my hand off my weapon till he gets his ugly ass off my property. just because he's an LEO doesn't mean he cant be shot for trespassing and putting you in fear of your life just like the local crack head.

    in ohio we only have castle doctrin which doesn't apply if outside of house and #2 it is illegal to touch a firearm when have a interaction with LEO

    When you see a guy going through your trash your first thought is to grab a gun?
    uh yeah, i live pretty much on a deserted stretch of road and 2 I already had it on me.

    Anyway, back to the OP, it doesn't matter what is in your contract with the CC company. Check out the Patriot Act (it has a whole section on meth) and recent CC legislation for your answers. This was part of the back and forth between the feds and cc companies/banks.

Not looking for an argument but, someone is tresspassing on your property, mearly identifies themselves as an LEO and your supposed to "obey"?:n00b: Apparently he didn't have a uniform on, or driving a marked car so HOW/WHY is one supposed to accept a tresspasser's word? AFTER he proved he was in fact an LEO then I can see your point.

    I don't want to call bull**** but how do you know the guy going through your trash wasn't someone who was looking for personal info for identity theft? Definately a good cover to say I'm a LEO if they got caught. I would have written down his name and license plate number.

    I don't know that a credit card is going to have info on what specific items I bought at a store. They would see the total cost but can they really tell what I bought? I can't imagine sending a police officer out every time someone buys allergy medicine.
    I've bought a lot of allergy medicine and have never heard of anything like this. I would be more inclined to believe that someone at the store called you in as suspicious than to think the CC company would waste time with this.
