    I want to do my part to see HB1143 (campus/state property) passed and HB1029 (drivers license handgun note) defeated. Who should I be contacting now???

    Contact the Committee Chairmen - 1029 is Road and Transportation- Rep Soliday is chair ; all the others are public policy Rep Dermody is chair - He needs to be pushed - now and hard and often.

    01-14-2015 IGA - Legislative Summary – PRIORITY 1: Keep Contacting the Committee Chairmen!

    Based on the “Rules” (or at least as I read them) today was the final day to file legislation for the 2015 IGA session. This session has generated over 1000 bills: Approximately 496 are in the state house, and 553 are in the state senate. There may be more bills that are filed that will not be posted until tomorrow or even Friday. So for now I will update the status of all of the ones that we have seen. We have not been able to completely review all of these, but we are going to try; unless we hear that they are ‘dead’.

    At this time – the KEY STEP is to get hearing for a vote by the various committees where the bills are assigned. That means we all need to CALL or WRITE (e-mail) the Committee Chairmen of each of the committees to urge them to hear the bills.

    In the House: The primary activity is in the PUBLIC POLICY committee. Rep. Lucas serves on, and has 3 bills before, this committee that need ALL the support we can muster. Please contact Rep. Dermody (h20@iga.in.gov or phone: ADD #’s). These bills are HB 1144 (Repeal LTCH requirement); HB 1143 (Possession of Firearms on State Property); and HB 1244 (Firearms on Business Premises). We need to persuade Rep. Dermody to hear these.

    Other bills in the house are as follow: There are 2 we oppose: HB 1029 (this is dead – see our last comment on our post on this); and HB 1107 (adds training ‘levels’ to LTCH; I expect this to be dead too.) There were, at last check, 2 new additions today, both by Mr. Lucas: HB 1430 (Criminal Enhancement for Firearms in Crime) and HB 1494 (Firearms Ownership and Medical Records) – Both look very positive from our initial quick scan.

    In the Senate there are another 9 bills proposed at last check, including several that we oppose. SB 46 and SB 48 are both unlikely to be heard and we are opposed to both. SB 46 is a redundant attempt to limit your rights to self-defense and SB 48 is an attempt to limit access to the LTCH by adding a training requirement. (Note: To be clear, we support training; but do not feel it should be mandatory to exercise your right.) SB 176 proposes adding an age limit and ID requirement to purchase Tannerite (explosive target material) – this is a solution to a problem that does not seem to exist. SB 215 and SB 224 are nearly identical and are assigned to the same committee. SB 224 is the more comprehensive so is more likely of these to be heard. As this stands we are not in favor of the entire package of these two.

    On the positive side, at least at the cursory reviews we have completed are SB 279, which increases penalties and level for crime with a firearm. SB 107 (similar to Mr. Lucas’ HB 1244) provides protection to businesses from unnecessary liabilities for not prohibiting firearms. SB 366 provides protection against insurance increases (or denials/cancellation) based solely on firearm ownership (this does not affect, or apply to, a rider policy to insure a gun collection). And SB 433 removes Indiana’s Ban on certain Shotguns (legalizes Short-Barrel Shotguns) which are controlled under the NFA. A federal tax stamp and approvals would still be required. This bill has a significant list of Bi-Partisan co-authors supporting it.

    I also just saw SB 366 has a hearing on Jan 22.

    Synopsis: BMV documentation indicating a handgun license. Provides that an individual
    must indicate on an application for or a renewal of a driver's license, permit, or
    identification card whether the individual possesses a handgun license (license). Requires
    the bureau of motor vehicles (bureau) to verify whether the individual has a license by
    contacting the superintendent of the state police department. Requires the bureau to place
    a notation on the individual's driver's license, permit, or identification card that indicates
    that the individual possesses a license. Makes a technical correction.
    Effective: July 1, 2015.

    Synopsis: Handgun training and reciprocity license. Provides that a person who: (1) is at
    least 21 years of age; and (2) successfully completes a handgun safety and training
    course that meets certain requirements; may have the superintendent of state police place
    an identifying symbol on the face of the person's four year Indiana handgun license that
    the person may refer to in attempting to qualify for a firearms reciprocity license issued by
    another state or a political subdivision of another state. Requires the superintendent of
    state police to retain a copy of the person's handgun safety and training course certificate
    of completion for at least four years.
    Effective: July 1, 2015.

    state supported college or university, from regulating the possession or transportation of
    firearms, ammunition, or firearm accessories: (1) on land that is; or (2) in buildings and
    other structures that are; owned or leased by the state. Provides for certain exceptions.
    Voids, as of July 1, 2015, any rules or policies enacted or undertaken by a state agency

    Synopsis: Firearms on business premises. Permits a person to bring an action for
    damages against a business entity having a policy of barring possession of a firearm on
    the entity's property, if: (1) the person suffers a loss due to criminal activity on the entity's
    property; and (2) the loss could have been avoided or reduced if the business entity did
    not prohibit possession of a firearm on its property. Provides that a person who does not
    prohibit: (1) an individual from possessing a firearm on the person's property; or (2) the
    person's employees from possessing a firearm while the employees are acting within the
    scope of their employment; is immune from civil liability with respect to any claim based on
    the person's failure to adopt such a policy.
    Effective: July 1, 2015.

    Synopsis: Firearm ownership and medical records. Prohibits a practitioner or medical
    records custodian from disclosing certain information relating to a patient's ownership of a
    firearm. Prohibits a political subdivision or the board regulating a practitioner from
    requiring the practitioner to: (1) inquire whether a patient owns a firearm; (2) document in a
    patient's medical record whether the patient owns a firearm; or (3) notify any governmental
    entity of the patient's identification solely on the basis of the patient's ownership of a
    firearm.
    Effective: July 1, 2015.
