    Doesn’t judicial immunity require the court to have at least apparent jurisdiction over the matter in question? I am having difficulty with it being a judicial act, much less an exercise of jurisdiction.

    Yep. Walking by an attorney answering questions about Pinner in the hallway, or reading about how Kirk linked the Pinner decision or Guy Relford's article on Pinner on Facebook or seeing the APRA/FOIA request at the judges' meeting (or however she became aware of me filing it) is hardly the establishment of jurisdiction.

    AG said that entire courthouse was her jurisdiction--judicial acts everywhere, and all I survey is my jurisdiction. It fits nicely with the fictional crime, but no judicial immunity.

    However, I know that 91D01 is the trial court argument that must be done before we go up (either way) to the Court of Appeals and then (a shot) at the Indiana Supreme Court.

    Appellate work is always fun. I have a pretty important case (actually 3 consolidated cases) in the middle of transfer briefing right now. We won at the COA.

    I am on the side of some reasonable limit to judicial immunity.

    Just want to get past this and get to the discovery and have her start naming names to see who else was involved in this against me.

    I can hardly wait to get to court tomorrow. They have all been walking on pins and needles over this. The suspense must be getting to them. Going to talk loud tomorrow!

    Need to resolve the judicial immunity issue before I start sitting people down for depositions--won't the Courthouse Gang love that!:D

    Any idea of the timeframe for the ruling so you can get it to the appellate court?

    No idea. I would speculate that he'll give it the weekend, come into the office in jeans over the weekend and give it a think. Could be 2 weekends if he has a trial or something coming up.'

    I don't know, but will let you know when I get the order on the Motion to Dismiss.

    Again, I don't want it in the Appellate Court but either way that is where it is going. It's an important legal issue--where is the line on judicial immunity--and deserves consideration.
