    Basically as my CO friend explained to me on the phone when all of this was going down, he could not arrest the guy for trespassing unless the land owner wanted to do so. The land owner is my mother in law who is in her mid 70's and believes that by The Good Book to extend Grace. The neighbor who let him through via his gate is pretty.much of the same mind set. Both were not happy but hope this guy learned a lesson and now he has no legal access to the property anyway. Personally, I wanted him arrested, but I don't extend Grace by nature the way they do.

    Crooks sure do love people like that.

    The property surrounding landlocked property is often subject to an easement of necessity, so I wouldn’t be so certain that he can’t legally cross your relatives land. It depends on a whole bunch of things, but there is generally a presumption that people get to access their property.

    Also, IIRC a leo cannot arrest for criminal trespassing unless it occurs in his presence, and from what has been posted it is not clear that he actually committed criminal trespass.

    Trust me, it is 1000% land locked with no legal easements. It happened several generations ago. We have done the homework. In all honesty, we are trying to strike a deal with the last living trust owners to buy it as no one in the family wants property that they have to pay taxes on and have no access to. This dumb azz is dating a grand daughter of one of the last living trusties. He begged her to let him hunt. She said "if you can find a neighbor to let you in sure". One neighbor (the one with the tractor) gave in ... it won't happen again.

    Regarding the LEO. I had him on the phone and he said "get your mother in law to say the word and I will be there in under 10 minutes to arrest him." Where was the guy going to go? His car was buried. All I had to do was tell the nice neighbor who had the tractor there to just let it all sit.

    I love how everyone armchairs this. I had the CO on the phone with me the entire time. I know the legal property lines and all legal parties involved. I didn't mean to hijack the deer hunting thread to be about my incident for this long. Just shared the nightmare of a day because I could have never made a story up like this one in my wildest dreams.

    Really? When the actual owner of the property isn’t even wanting him criminally trespassed?

    It is kind of fascinating to me that the will of the people who actually OWN both pieces of property seems to mean nothing to most anyone here.

    Never mind the half dozen other legal issues present here.

    Easment may already exist even if unrecorded, who knows. Still fascinated that no one seems to care what the actual owners want.

    I took took a nice 7 point yesterday. He was an older guy and came in with several doe’s about 7:30 a.m. I had only been in my stand about 15 minutes. Not sure what he weighed but he was a haus. I will be mounting him for sure. The best part was the shot took both lungs and the heart. He dropped right where I shot him.
    i went back to my stand later and watched a bigger buck come in. He played around for a while and I sat and watched him. All in all it was a great day to hang out in the woods. This was also my first buck and I was hunting with my dad which made it even better.

    Im glad you guys are seeing bucks with doe's. I have not seen one little sign of the rut in well over a week. I'm not seeing much movement, and what I am seeing is all at night.

    Took 2 BIG does yesterday. In the past week I have not seen a lot of bucks chasing or following the does around the property. I am sure hunting pressure on the surrounding land has changed their activity a little.

    I missed a nice one today. 20 minutes later my daughter dropped it. Eight point, 170 yards. I was watching it in the scope when she shot it from her stand. Pretty cool to see.

    Another year older this week and yet i still pulled a rookie mistake. Rushed a shot and missed a nice buck today. Sucks, haven't missed one in quite awhile. Spent a couple hours looking for blood. Found nothing, using a 50 beowulf with a hornady xtp blood trails never been an issue. I just wiffed it i guess.

    Another year older this week and yet i still pulled a rookie mistake. Rushed a shot and missed a nice buck today. Sucks, haven't missed one in quite awhile. Spent a couple hours looking for blood. Found nothing, using a 50 beowulf with a hornady xtp blood trails never been an issue. I just wiffed it i guess.
    Did the exact same thing 20 minutes into the season. Too easy of a shot that I rushed. It sucks but such is life.

    Took the 9 year old out this evening but nothing was moving. Did see a buck following a doe in a draw we drove past.

    All I got was a button buck this year. Missed a shot on a small buck. Thought he was going to run right in to my BIL (who was on his first hunt ever) so I let the easy shot pass...buck turned and headed the other way, I rushed and shot...of course I missed completely.
