    Well, not a free man quite yet. There is still the chance that DCA could take up the matter en banc sua sponte.

    I keep seeing Lawfare twitter state that Sullivan can appeal; but no one has yet answered the question of how a non-party has standing to appeal an order from the court of appeals. (Nor has anyone answered the question if, should Sullivan somehow have standing to appeal, the action of appeal would cause Sullivan to be an adversarial party to the defendant, and therefore statutorily required to recuse himself.)

    Long read, but this interview with Flynn's attorney, Sidney Powell, covers all aspects currently publicly known about the Flynn [STRIKE]prosecution[/STRIKE] persecution. It hints there is more that maybe sealed for possible prosecution under Durham's probe.

    No doubt in my mind, it was payback for calling out Obama's attempted "manipulation" of DNI intelligence, leading to Flynn's firing from the Obama administration, and participating in the "lock her up" chants during the 2016 election.

    Yes. I think judicial immunity is cut from the same cloth as qualified immunity for cops, no? Perhaps if qualified immunity goes away and cops have to buy liability insurance, perhaps judges and prosecutors can do so as well.

    The DCA voted to rehear en banc. Oral arguments set for 11 August. Seems their angle will be whether mandamus was the only adequate means for the relief sought.

    I'm hoping Flynn or DOJ petition for cert with SCOTUS on the grounds that he has no standing to petition for rehearing en banc.

    Yes, as near as I can tell it has happened every time the FBI has conspired to entrap someone and hide evidence for political reasons.

    From what I have read it is not unusual for someone to plead guilty and later change their minds and withdraw it. Flynn wants to withdraw his plea, and the Justice Dept wants to then drop the charges.

    Just out of curiosity, has anyone ever heard of the federal government pursuing charges after admitting that the underlying facts do not support any crime, conducting an interview without notifying the subject that the interview was part of that (known baseless) criminal investigation, charging that subject with a standalone 1001 crime, manipulating multiple times and then losing the evidentiary source material (i.e. the original Form 302) to support the charge, coercing a defendant to plead guilty under threat of bringing charges against the defendant's family members, allowing a defendant to plead guilty under the advice of counsel known by the feds to have non-waivable conflict of interest, and failing to disclose Brady material?

    Edited to add: not to ignore your actual question. You should look at the cited case references in DOJ's filings related to the petition for writ of mandamus. This is not the first time that charges have been withdrawn after a guilty plea.

    Just out of curiosity. Who is more concerned about the FBI's conduct in the Flynn case under Comey's leadership than anything Flynn did? Raise your hand.
