Why did he accept the plea? If he chose to accept the plea when of sound mind and body...then he gets all that comes with it

Because the alternative may very well be wrongful prison time. Serving ten years in prison is quite a long time if you know you are innocent... and at that point retribution may take a backseat to freedom...

Just because you are innocent, does not mean you will not serve time in prison.

Innocent until proven guilty is more of an ideal than an actual practice in our justice system.

    What a delightfully simplistic view.

    It doesn't seem very complicated
Do any serious reading at all about our justice system, and you'll see that innocence is no defense. There is no such thing as a fair trial when one side has virtually limitless resources and the other side doesn't. If you shoot someone in self defense and it goes to trial, you will almost certainly lose your house, whether you win or not. The costs of fighting a conviction only get worse from there.

Engage your imagination a bit, and envision yourself in Cory Maye's shoes. You've served the last 10 years in prison, 5 of them on death row for a righteous self-defense shooting that got railroaded into a conviction. You get offered a plea deal for time served. Are you seriously suggesting that you'd rather just stay in prison and continue fighting it out, instead of taking the deal?

Knock on the door like a man.QUOTE]

our troops do no knock raids every day because of the tactical advantage, what makes it ok for them to do it but not LE
Cops aren't soldiers and aren't supposed to be. The fact that they keep acting like they are soldiers has led to many a tragedy in this country and will, in time, lead to a wider gulf between cops and the people. Militarisation of the police is not a good thing. Even soldiers screw up quite often on their "no-knock" raids and kill innocent men, women and children. That's reason enough right there to get rid of the practice.

believe me, I can relate. It's just sad to see a man defensing his children from an unknown danger suffer a life of future consequences due to a wrongful conviction.

Now there will be no defending his family with a firearm. That IMO is just wrong.

Our troops are in a WAR. Our cops are not, despite all the inflammatory and ridiculous rhetoric to the contrary.

In a war, you do what you need to do to win. Law enforcement has other options. If you want to equate the two, why not simply advocate dropping bombs on people to enforce the law?

Sitting across the street in an unmarked car, just to lase the house with weed in it for an airstrike, would be GREAT for officer safety. So let's not give Arizona any ideas, eh?

Because... our troops aren't claiming to be public servants to the people they are engaging. And this isn't Falleujah.

Like the cops in Philly did to the MOVE people? That worked out well. Let's not give them any ideas.

No, your view of the situation is childish and simplistic. Picture yourself in Maye's shoes.

You're sitting in prison. You have been sitting in prison for a long time, sentenced and waiting to die. The only reason the death sentence is changed to life imprisonment is because some newsman you've never heard of made a stink about your case; there are no other allies that can affect anything.

Along comes a deal. Say you've been guilty and you can go home. Refuse and you sit in prison fighting a system that can bring the legal and financial resources of an entire nation against you - while your family probably can't get any lawyer without selling themselves into debt forever, if they haven't already done that. You plea and you go home. You refuse, you pursue justice, and you get to rot in prison and fight a system that has you outgunned and has already proven itself willing to pursue an unjust conviction even if it results in your death.

Were I in his shoes I'd take the deal so fast it's not even funny. Justice? What justice? There is no justice for this man anymore.

So when we round up known terrorist's overseas, its ok, but when we wanna pick up "Osama Bin Laden II" living in rural Kansas, the only "man" way to do it is to knock, ask his wife if he's home? if not, when will he be back? can we come inside and take a look around?

no knock raids are performed flawlessly in this country daily to successfully round up the worst of the worst because it provides an obvious tactical advantage. Many of these "SWAT" teams are nothing more than glorafied mall cops with body armor and an MP5, and poor outcomes from their lack of training shows that. Will I completely agree they are overused/abused, But we the people hold the control in our hands...we elect the judges who sign the warrant's

Our troops are fighting a war. In a war, people fight back. If you want to declare war on the American people, we will fight back. Do you want us to start fighting back?

So are you saying that when somebody admits guilt to a crime, we shouldn't treat them as such?
You cannot seriously be as stupid as you're pretending to be. This isn't all that hard to understand. If you put somebody -- anybody -- under enough pressure and in enough misery, they will cave. 5 years on death row and 5 years in prison, FOR DOING NOTHING WRONG, would make almost anyone willing to sign a plea deal to get out. It works the same way as torturing someone until they'll confess to witchcraft.

But Fletch, you can't possibly be insinuating that District Attorneys and other non-uniformed law enforcement officers would ever be willing to imprison a man simply to maintain political viability, especially if a particular case is of a high enough profile can you? That's unthinkable.

I ain't insinuating anything. I'm coming right out and saying it.

Anyone who honestly believes our system is as devoted to the concept of pure justice and as infallible as the cop shows make it out to be, needs to go back to kindergarten and play quietly while the adults talk.
