When they give kids the same age condoms at school and encourage "safe sex" this is hypocritical.

Good point!! Have sex, just don't take a picture of a breast for goodness sake!!

I too find it a bit ridiculous that it's legal for children to have sex, but taking pictures is straight out.

My HS g/f may or may not have sent me nudes too. She may or may not have took them with a 35mm and had them developed and sent them to me in a letter.

I also may or may not have showed them to my friends. (She also may or may not have given me the negs which also had her 2 friends on there!)

There is nothing new under the sun.

Two 15-year-olds, a boy and girl, were arrested for transmitting a picture of the girl's bare breast, via text message. The two are facing felony charges of child pornography. They could get a maximum of 5 years in prison, and will spend the rest of their lives as registered sex-offenders.

I doubt they'll see a jail, and they won't likely be registered sex offenders. Most of the time in these cases the prosecutors scare the crap out of them by
saying they could be facing these things. I'll be shocked if it isn't reduced to something much less and they aren't put on probation. I deal with this stuff all the time, and I've never seen a formal charge run all the way, and I've never seen a kid get jail time or be registered as a sex offender.

If anyone knows of a case where it went that far, please post a link. I'd still be that there would have to be more to it, such as a prior record or evidence of some kind of molestation of a younger child, or trying to sell the pics or passing them along to an adult. The way this one reads, I'd almost guarantee they are just scaring them.

I don't know of an Indiana school that hands out condoms. The ones I've worked for encourage abstinence. I can't speak for others, though. I don't think we have enough information in this story about these kids' school to know for sure, but if that were true, I'd agree that it is indeed hypocritical.

So we are *****ing about the laws, *****ing about them being charged and the repercussions but not once has anyone said anything about the parents. Why is a child at that age even allowed to send or receive picture messages? It takes a phone call or a stroke of a key when signing the contract to disable this feature. It seems since the late 90's we play the blame game for what kids are doing wrong and the parents are never to blame. It is always well it is because he has add, or listened to marilyn manson, or that devil kiss music... wait that wasn't the 90s. Point is it could have been prevented and that is what we should focus on. Instead of creating legislation and pharmaceuticals how about people act as good parents. Want an example look no further than our own community with DaKruiser and HotPocket in most recent history.

When will kids (and congressmen) learn NOT to send photos and emails that would be a 'bad thing' if seen by the rest of the world?

come on. really this is our "justice system" ?? what a joke. when I was that age everyone didnt have cell phones and they didnt send picures, but if I had a picture of my GF's ******* you can BE SURE that I would have shown all my friends. so that would have made me a sex preditor? really? even though the girl willingly gave the picture to another MINOR?? we focus on so much of the wrong things anymore.

If it were my daughter I would be VERY ticked at her and disapointed, and also the boy, but I wouldnt even consider trying to turn it into a criminal issue. its not a rape or something.

What? Are you saying that as parents we shouldn't allow our children to make mistakes? IMO a 15 year old has the maturity to handle a digital camera. I mean in a year they are going to be piloting a 3500 lb death machine around city streets with other idiots piloting the same things, but "they shouldn't be allowed to text or send pictures"? WTF??? I had to learn the hard way about nude pictures, drawings, asking girls about sex etc. I think I'm a better man for the mistakes I've made and I don't expect anything any different for my son.

That's nothing, there is a kid here in Indiana (Rushville) who is facing 8 yrs. for bringing a blow-up doll (you know the kind) to school. That is more than if he had brought a gun to school.

W:n00b:W. a stupid thing for sure, but kids are allowed to make mistakes like that and not be unjustly imprisoned for them. sure maybe he deserves to be expelled, but imprisoned? what a joke! the shame I have for these politicians and some police these days is just growing daily.

I agree that it is wrong for them to send the pics. But I don't see the victim here? The girl chose to send the pics, what happens to them afterwards is her fault. So who is the victim? If she was made to take the pics or someone did it with out her knowledge I could see it being a problem, but its not. If her 22 year old boyfriend took the pics, then it would be child porn.

This is something that should have been handled by the parents and not gotten any further.

The problem is simply that this country has a real hang with how we all got here - S-E-X. It's some dirty little secret in the corner. We can't even run British TV shows here or BBC news without it being cut or blurred - they show butts!

Brain spatter -PG or PG-13. One boobie - R.
Protect your child from that boobie - it could put an eye out?!?!

Your right lets just dope kids up before they get behind the wheel as well, a couple ounces of jamaica's finest and a fifth of jack for every new driver. Any other laws you want to tell your kid to break while your at it?

    Indiana BMV said:
If you get a probationary driver's license on or after July 1, 2009 and you are under 18, then you may not operate a motor vehicle while using any type of electronic (telecommunication) device until the individual becomes eighteen (18) years of age unless the telecommunications device is being used to make a 911 emergency call.

I am saying as parents had they done right by raising the child the whole sexting craze would be a none issue. Don't do something stupid, and if your going to don't create any evidence like pictures or video to prove your stupidity. If there is no evidence it is all hearsay, if there is picture and video that is prosecution exhibits a and b. Not saying kids can't make mistakes but as young adults they should be and required to be more responsible. Also for the record I never said they shouldn't be able to text I said picture messages, because even if I raise my kid right doesn't mean every other adult in the school system did. Kid's use cell phones, computers, and other technology to get away with far more **** than I ever did as a kid so you can either be proactive and eliminate that possibility that may have that mistake cross from good ol' fun to criminal activity or not.

Kids are no-where near as innocent as we try to pretend they are. Every generation did this kinda stuff, the technology just changes. I remember ::friends:: getting emails with that kinda content from their sig others when we were that age...

Age based laws are terrible. Is an 18 year old really any different than a 16 year old?

Bravo!!! My sentiments exactly, if we all only admitted our youthful transgressions while mounted on our high horses!

I guess the moral of this story is to just expose yourself to your friends in person without using digital media.

You really need to take a logic class or something. This argument is so fallacious it is astounding.

Not saying kids can't make mistakes but as young adults they should be and required to be more responsible.

That's the main issue here I think. We give and expect certain levels of responsibility from teens in many areas, yet when it comes to sex we try to overly shelter them. We ignore the fact that plenty of kids start having sex in middle school/early high school and raise a cry of protecting the children when it comes to child pornography laws. It is incredibly stupid and so long as we have these laws you'll see more of this garbage pop up.
