Lincoln, Nebraska, 12/21/2010. Well, here's the rundown. There is a 20 minute video here of an incident and the aftermath. A guy was practicing shooting his bow at a target in his backyard, which apparently is against ordinance. He refuses to present an ID and is tackled on his front step and arrested. It is unclear but someone received a minor injury from the wrestling match.

Everybody can have an opinion about the above matter; but regardless of of who was the most wrong in this situation...

Where it gets interesting legally, is that the police tell the man's wife to pack her kid up and leave because they are seizing her house - prior to having a warrant.

So... reserving my opinions on the matter, what say you? Is it common to seize a home because an infraction took place outside of it?

If you want to cut straight to the "seizure" part of the video, go to about 7:00 of the second video.

well he did need to self identify if he was in violation of the law.

WHY did that wife talk to the police????? WHEN are people gonna comprehend, " I REFUSE TO ANSWER ANY QUESTIONS!"

Stop talking to the police you fools or you get what YOU get!

this lady would have been just fine if she would have just stayed inside and kept the door shut. not cracked open,,,, SHUT *****!!!!!

not trying to thread jack but is shooting a bow in your backyard (mine for example is totally enclosed) legal in indiana? or is it more of a town based thing?

I'm not sure, but I don't think an enforcement officer can seize a home without some sort of order from a judge? Also, I don't think a judge can even do it over an infraction or for violating an ordinance, but rather it would have to at least be a felony or a habitual problem at least?.....I smell a BIG lawsuit against the department and perhaps even criminal charges against the officers?

"I have nothing to say. My attorney will be along shortly". Repeat as necessary. When will people understand---you DO NOT talk to the police without Counsel present. PERIOD.

I agree with phylodog. I don't think this is going to play out the way the PD would like for it to.

Not saying she brought this on herself at all. However, she should have sat inside, watched Oprah, and refused to answer the door. All the bad stuff that was going to happen had already happened. Now they are attempting a pile on and will make life hell for them. Reference the child abuse charges.

Being poor is not a crime. Abuse of power should be.

I know in Columbus there is an ordinance against it. My father and late grandfather helped organize for the city council hearing against it. Our ordinance (the last time I saw it) was very poorly worded, in that following the letter of the ordinance, anyone hitting a baseball, golfball, or any other object "with deadly force" is in violation of the ordinance.

Still deny we live in a police state? if you don't!:twocents: Nothing to do with the fact the guy broke the law and should have been warned or written a citation. But no one can justify the way the police handled the situation. The police decided without a warrant or a court order to seize a private residence, forceably evicting the mother and child because they wanted to look around inside with out cause or a warrant? WTF ZEEK HILE!!! LNPD!!

Can't wait to build the backstop for my 400 yard range this spring.

You should host an INGO General Political Discussion shoot. You need to something with that kick butt house you built! Nothing brings together different opinions on politics like barbecued meat and firepower. :rockwoot:
