LTCH... Do I have to provide if asked?

    I have my lifetime LTCH in the state of Indiana.. However I very rarely do carry one with me... So.. If I get pulled over by a LEO and he determines that I have a LTCH by my DL or LP and asks to see my LTCH.... do I need to provide it even though I do not have a HG on my person? or in my vehicle?

    And if he dose not believe me doe's he have the right to search my person, and or vehicle?

    Without a handgun in your possession there is no need to carry your Larry.

    The search requirements would be the same as any other. PC for arrest, warrant, RAS for armed and dangerous or suspicion of criminal activity.

    No, and no, assuming no weird other junk (someone says someone matching your description in a car that looks like yours just robbed a liquor store at gunpoint...)

    TECHNICALLY, you are not required to show your LTCH upon request.

    In Indiana, it is a crime to carry a handgun without a license. You have two choices, you can show your ltch, or you can refuse to. If you refuse to, you will receive a complementary ride to jail. Sooner or later, you can show the prosecutor that you are properly licensed. When that happens, all record of your arrest will be expunged and the prosecutor will look at you and think, "what an incredible tool."

    It's completely up to you.

    Actually, you won't go to jail. A person will be disarmed and cuffed, and in the process your LTCH will be found. It will be checked, the person will probably looked upon as an idiot, and then let go. I guess if you like your "junk" fondled by strangers, it's a pretty good deal.

    I would NOT suggest this. However, if you agreed to identify yourself via a DL, then you should be alright if the BMV is working. BUT, if it is not, and that happens from time to time, you will be arrested until your status is known.

    Think you misread his post. There is nothing to arrest him on. He does NOT have either the ltc or the handgun on him.

    Wow, that is a good deal. Some people pay a lot of money for that. That is taking the 'serve' of 'protect and serve' to a whole new level. ;)
    Guess officers should watch out for repeat offenders :cool:

    OP, bottom line, the answer in "NO", there is no duty to inform the LEO that you are carrying or have an LTCH. However, if the LEO asks, why not just be courteous and let him see you LTCH and move on. You will avoid any potential problems and possibly an argument with the LEO, who will not doubt at that point call his friends.

    Not to nitpick here, but you are making a broad generalization here.

    The situations are vastly different, OC vs CC.

    If you are CC, and a LEO asks you, out of the blue "are you carrying? can I see your LTCH?" then I agree with your position.

    If you are OC, however, he SEES you have a gun, and IC would seem to suggest that he has the legal ability to ask for your LTCH...

    Is this what gives us the right to say have a nice day and walk away after showing our LTCH and they continue to question us? Really, it is a serious question.

    I wish they would add an amendment specifically stating questioning/detainment should cease and desist once a valid LTCH has been presented.

    There is nothing under the IC that requires a person show that they are licensed to carry a firearm. The problem arises that when asked for your LTCH and you don't show it, you can be arrested or detained as being unlicensed to carry until you prove you have one. Once proven you have an LTCH all charges must be dropped and record of arrest destroyed.

    Not showing when asked would NOT be the smart thing to do, but not against the law for not showing your LTCH.

    What gives you the right is the 4th amendment. Once you have shown your ltch, you have proven that you aren't doing anything illegal.
