    Every time a thread starts up about drinking and driving, everyone denies that they would ever drink and drive and then several people get belligerent about the OWI and DUI laws being enforced almost as if....it's personal.

    Back the Bill Cosby routine cited elsewhere:

    "I didn't put a bullet in the furnace so you stop talking about my mother!"

    Lol. Even 350 extra cops would cost Marion county taxpayers 25 million dollars annually, just on salaries. I will give you that DUI arrests would likely plummet.

    DUI's are the most litigated and scrutinized misdemeanor (sometimes a felony) there is. I've responded to and testified in homicide cases that were not litigated nearly as hard. BIG money is spent on DUI lawyers. There is little push to stiffen the penalties. Why? Because legislators drink too and many likely drink too much at times. Some of them probably drive drunk.

    This comports with one of my theories.... "nice" people get locked up for OWI, and the penalties, mostly collateral consequences, such as high insurance, are so strong, there is good money to be had by attorneys who specialize in OWI defense.

    A person walking home, drunk, cannot be arrested for PI, unless other factors exist. Being drunk in public is not a crime if there are no aggravating factors.


    Sec. 3 . (a) Subject to section 6.5 of this chapter, it is a Class B misdemeanor for a person to be in a public place or a place of public resort in a state of intoxication caused by the person's use of alcohol or a controlled substance (as defined in IC 35-48-1-9 ), if the person:
    (1) endangers the person's life;

    (2) endangers the life of another person;

    (3) breaches the peace or is in imminent danger of breaching the peace;  or

    (4) harasses, annoys, or alarms another person.


    Thank you for clarifying. I am glad to see that it is limited.

    However, I would still rather see it removed 100%, totally and completely gone. If a person is causing a problem in another manner, endangering someone, breaching the peace, etc then I would much prefer that they do face consequences for their action(s) and not their level of sobriety or inebriation.

    I don't want there to be many laws. It turns us into a nanny state and over-complicates the system. The laws that are there should smack the tar out of folks that break them. Few laws, big slaps. That's what I would like to see.

    Won't happen. I know I'll never get my way.

    Which do do you think the public would approve more or less of? Checking a couple hundred cars once a month in data-driven dui/crash intensive areas, or having to go face to face with a cop every time you go out and have a drink?

    So someone on INGO is advocating for police being stationed everyplace that has a liquor license so that they can, without reasonable suspicion, give breath tests and determine who can and cannot drive.

    I just want to make sure I understand this.

    Will they also be allowed to check IDs for underaged people? Maybe inspect LTCHs for anyone carrying? Heck, they are there anyway.

    I agree with you entirely on why it won't be changed, although I didn't know that it was fought over so hard.

    But I still believe that if the first offense were even a minimum of 30 days in jail to a maximum of 90 days, served in order (ie. no weekend nonsense) then the fear of even getting a first offense would motivate the majority of people to act more responsibly. Because with 30 days in jail that could mean your job, your house, your everything, at least for a while.


    This is not how addicts operate. It is also the type of rational thought that alcohol numbs pretty rapidly. You will or you won't do it whether you know the consequences or not. If you are a person prone to acting irrationally it's wise to leave home with a plan like an accountabilibuddy or a dd, or go out using an uber.

    Does anyone know of any data that correlates BAC with number of crashes or number of injuries / deaths from DUI?

    I'm curious how many deaths were caused by people between 0.10 and 0.08 before that change, how many are caused by people between 0.08 and 0.05? If the change eliminates all drunk drivers in that range (which it won't) what difference will it make?
