    Not that I know personally, but heard from a friend of a friend, that in Evansville 50 years ago when the Civic Center parking lot was a brewery and a few whcre houses, if you spit on a cop they beat the dog shat out of you, then beat you for the shatting.

    Yes it was. Nobody got their panties in a twist over a reasonable use of force even 15 years ago. Now everyone demands a Supreme Court trial if someone gets hurt feelings.
    It was better because everyone and his brother didn't have a camera. Pukes still baited officers and abused them. I'm not sure how the system handles the complaints of police brutality now, though. Minority opinion (and I'm not necessarily talking about race) does seem to get a lot of play time on the news media and therefore much more consideration by politicians, especially in certain locales where liberals rule.

    IIRC there was a time when the offense applied only to acts against public safety employees (it was a felony even then)...

    OK, but when the law was changed to include everybody, the penalty should be the same no matter who is spit on.
    UNLESS somebody can show that non-public officials have some extra immunity from disease that public officials don't have.

    In fact, this is a prime example of a violation of the civil right of "equal protection under the law".

    Agreed. Hell, I even empathize with those Elkhart City police officers that did just that. Unfortunately, whether the guy deserved it or not (he 1000% did,) those officers did go a little too far. I've been spit on several times. It sucks. Especially when you know they are HIV or HEP positive. Low chance of transmission, but still isn't fun. Every single person who has spit on me, or another of my officers gets a swift palm strike to the face. One strike to turn their head away from you, to keep them from doing it again. We also all carry spit hoods, and if we think someone is going to spit, we put a hood on them. Our job is not to administer punishment, but I think most people's reaction to being spat upon is to beat that person to a pulp. Unfortunately for hose EPD officers, they lost their jobs, and are now facing criminal charges. That guy got beaten to a pulp, like he deserved, but in the end, he wins.

    I’m all for the officers beating the living **** out of someone who spits on them... especially during a pandemic, or knowing they’re infected with hep. Level 6 felony isn’t **** to most of the people who are the type to spit in a cops face anyway, up the charge to something worthwhile and you don’t put officers in a position to need to knock their teeth out. It’s ridiculous our courts rarely defend LEO in situations like this. I really feel for you guys having to deal with this during every crisis, pandemic, whatever. Thank you

    When I was a cop back in the 1980s I remember reading one of Massad Ayoob's articles in which he suggested wearing mil-spec (not just safety glasses) lenses regardless of shift worked. Part of the reason was just protecting your eyes in general (shattered windshield in a crash, for example), and the other part was to protect from *******s spitting on you, since the eyes are an easy entrance for germs and viruses.

    He suggested mil-spec for the additional protection over regular Z87-rated safety glasses, and suggested clear lenses if you worked nights, and photochromic lenses if you worked days.

    Last I checked, the mil-spec glasses were made by ESS, Oakley, Smith Optics, and WileyX.

    I was searching Indiana Code, but wasn't sure what terminology to use.

    But the law should have the same penalty, and not some extra penalty for public officials.
    I politely disagree.
    I've stated before that I believe if public officials (including police officers) betray the public trust while on duty they SHOULD face stiffer penalties. That's never a popular opinion with LEO's or public officials. I understand.

    But I also believe that people who assault public officials or first responders SHOULD face stiffer penalties. We MUST try to prevent this as best as possible or if you're going to commit these acts then you SHOULD pay dearly for it IMO.
    Assaulting a first responder is not the same as if you assault ME an average Joe blow. I am not an essential person to the system. Yes, I matter to my loved ones but RULE OF LAW must be maintained and you cannot have a run on your cops like we are seeing in places like NYC as common place. It will all break down.

    I'm not a cop or a lawyer so I don't know all of the laws but we have those here who are. Isn't there already laws that make it a crime to assault first responders? My spouse used to be one and I believe I remember being told about that once but it's been many years ago.
    We must push for the max penalties for offenders who assault first responders. This is something we should all be writing letters to our elected state and federal officials about. It should be a max felony.
    But it also shouldn't be misused as a F-you (abused) by police or prosecutors against people they chase or fight. If someone doesn't truly try and assault you then do not add bogus charges on them.
    I dont like seeing that kind of BS. It does happen.
    I want fairness no shady stuff, and I'm sure the vast majority do not pull BS like that, I'm just saying it has to be applied fairly, kinda like a citizen who false reports. They SHOULD be prosecuted fully, but rarely are.
    But we all have to stand behind our first responders. They are the front line on the homefront

    F***in' with a cop is especially heinous.

    These ass hats are looking for a big pay day by the way of the courts by pushing LEO to smack their worthless waste of skin heads into the next zip code.

    We have allowed this to escalate from lack of actions by the courts that are also in fear of racial and social backlash.

    Since when do the courts fear anything. I can say beyond a shadow of a doubt if I pulled some idiot crap like that my butt would take the full ride.

    Live PD hands out tickets for not making room for PD on the highway. I never had to deal with these issues the 6 years I was with the Sheriff's department. I worked with some old timers that did the brake check/cage check. It was a different world. Maybe not better, but different. I don't know how all of you deal with it daily, but I applaud you for doing it. I greatly appreciate all as I have seen it from that side and it is a difficult job, from 0 to 100 in less than a second. Decisions made in milliseconds yet debated for days by others.

    I hate that yelling stop only means run faster. It is a lack of respect that has developed further with spitting. On FOX this morning they showed an NYPD officer get blindsided by a man wearing a mask. It is ridiculous the attitude shown by the people in that video. It is what we see a microcosm of what I see in the classroom with specific students. Be careful all out there.

    I edited to add, a prosecutor should have to ride so many hours with law enforcement. Deputize them and let them get in on being spit on. Bet things would look different to them then.

    The only police car the Marion County Prosecutor will voluntarily ride in is the one that takes him to and from work every day. And from what I hear, he talks all kind of **** about police officers during the car rides.

    I certainly respect the job our first responders do.
    (My grandfather was a Sheriff's Deputy who died from gunshot wounds making an arrest.)
    I just disagree that if the penalty was a Level 6 Felony no matter WHO the victim is, that there would be less deterrence to spit on a public official.

    Yea I'd end up in jail if someone spit on me. Not sure how you guys do it but glad you do. Outta be allowed to shoot a little spray foam in the mouth when they do that. Kind of like securing a weapon.
