Any police officer in Indiana can pull you over and ticket you, as long as they meet one of two criteria. The officer has to either be in a fully marked car that is easily recognizable as a police car by the general public, or they can be in an unmarked car but have to wear a full police uniform that is easily recognizable as a police uniform by the general public. That is only to enforce the traffic code. If you are being stopped for an investigation of a crime that isn't in the traffic code, such as public intoxication or theft, there is no requirement for uniforms or vehicles.

In addition to the above stated facts, they apply anywhere in the state of Indiana's borders irregardless of the agency. Indiana is not like some states that have jurisdictional limitations like many people think.

So if you pull me over in your patrol car, but in jeans and an ACDC shirt, you can still ticket me? I wouldn't accept the ticket until a uniformed officer was called to the scene. No offense.

Well I don't own an AC/DC shirt, so you don't have to worry about that. No offense taken, the longer we sit by the side of the road, the more overtime money I get for off-duty work.

Really? Sweet. Pull me over off-duty sometime and I'll help you out with that! :D Just look for the F150 with the dent in the bed, INGO sticker, and the guy not wearing his seat belt. :):

I would not have left either imagine the "man hunt" that it might cause. I think you acted the right way by staying, yeah you could have left and maybe nothing happens. What happens when they pull you over down the road with 10 cop cars each with guns drawn imagine how that would go down. Not to mention what happens when someone's finger get a little to "itchy", not saying LEO are itching to shoot people but sh*t happens.

Man hunt based on what? sorry to bring this up again but I would like to reiterate that no laws were broken therefore they have nothing to base a manhunt on. Like I said before Im outta there its the same concept as what jbombelli said. Just dont put yourself in this position! If you are unsure whether you broke a law or not so youre scared and think you should stay you shouldn't be carrying a gun if you don't know what the rules are in the first place! Im not putting you down in any way SilentVoice again I believe what they did was wrong if the story is exactly as you said it. When someone looks at this page and sees the responses they need to know that you don't have to wait for the police to get there if someone calls the cops on you. You have committed no crime! This just baffles me that you would wait for the cops to get there in this case. Im not saying run from the cops. What Im saying is go on about your merry business when you know you're not doing anything wrong ok? Ok now that I got that off my chest :ingo: Good luck Silent Voice

I don't make it out to Plainfield much except to go to ILEA for training, so I don't think you have to worry about me running into you. I don't even drive my police car much off-duty unless I'm going to court, so you don't have to worry much about that either. If you were to give me an AC/DC shirt, make sure its XXL, I don't think I could wear one of yours :D . And you know if I pulled you over, I would definitely ask you if there were any guns in the vehicle :draw:

You don't HAVE to hand over your drivers license, they will just say ok and take you downtown to finger print you and find out who you are that way. Then I beleive if nothing comes up because you have not been printed before they will detain you untill you telll them.

So yes you are correct, you do not have to identify yourself.

I never posted that you don't have to identify yourself. I was just stating that according to the posted IC, you could do it verbally, without ID.

READ YOUR LICENSE TO CARRY A HANDGUN. IT'S STATED RIGHT ON IT THAT IT MUST BE SURRENDED TO LAW ENFORCEMENT UPON DEMAND. It doesn't say you can if you want, it doesn't say you have a choice. It says "MUST."

Feel free to refuse to hand over your LTCH when asked, and you're carrying a handgun, and see how long it takes them to put you in jail, since the burden is on YOU to prove you HAVE ONE.

Wrong........LTCH says nothing of the sort and never has as far as I know.
I would never refuse to hand over my LTCH and I never implied such.

From what I've found, the newer ones don't say that. But I am SURE the older ones did. I remember reading it many, many times. I'd hate to think I was going THAT insane... or getting that old and senile... but you never know.

That's all fine and dandy. I promise to stay out of your jurisdiction but on one condition. You gotta find a way to get me into the driving course of the ILEA. :D

Oh, and if you ask if I have a firearm you can only handle it if you escort me to the range. :rockwoot:

In my understanding, the state of Indiana is not traditional open carry state. However with an Indiana Permit open carry is LEGAL..... go to Opencarry.org it will decribe to you in full Article 1 section 32 of the state constitution

Even if the LTCH does not say it, case law (Harris v. State, 716 N.E.2d 406, 411 (Ind. 1999)) has supported that the burden of proof IS on the LTCH holder.

Do I agree with this? No. Has it been upheld by the courts, yes.

True that. I will not disagree that it is in your best interest legally. And personally, I have no problem presenting it.

Unfortunately, Article 1, Sec. 32 is not relevant to the LTCH.
The people shall have a right to bear arms, for the defense of themselves and the State.

It simply affirms our right to carry, but Indiana Law puts limits and conditions on that right.

As for OC, Indiana law is silent on open carry, therefore it is allowed by omission.
