What if your property was "re-zoned" after you purchased it? I don't know if this could happen, but it seems to me if all your neighbors were in favor of re-zoning you couldn''t do much to stop it. Would your property be grandfathered as is, or would you have to conform to the new zoning?:n00b:
This is a good point and it would definitely make me upset if it happened to me. Hopefully you'd have some say in the matter or be grandfathered in. In this particular case Then man has been illegal for all these years and someone final called him on it. At least that's my understanding. And they didn't just say you're out of here they told him follow the zones and he didn't.

This mans poo may have been getting in the ground water.

Looked at an old house on 80 acres several years ago, had an outhouse 400 feet from a springwell, had the watered tested, results came back positive for contamination of feces very high levels

You are typically grandfathered in. If the property sells, it does so under the new zoning. Of course, the rules CAN change for your property type, and you typically only have a certain amount of time to comply.

Ok, what's the benefit or purpose of zoning laws?
Keeps me from building a brothel, pig farm, mosque, or mud bog 6" off of your property line. Many folks "say" that you should do what you want with your own property. What they really mean is, "as long as you aren't my neighbor".

And how would a septic system improve that?
A proper system would contain the solids and provide a slow enough dispersion of the liquids that the run-off was properly digested and filtered.

Is it my property or is it not? Itsa sad day when my neighbors have more right to dictate what happens on my property than I do. This is an area where hoa's are actually a good thing. Find a group of people like yourself who don't want to live next to a brothel, pig farm, mosque, etc and buy land. Subdivide it and make all the rules you want and leave the rest of us the f alone.

So the pop from one man in a hole in the ground is going to contaminate the ground water but somehow a septic system being used by several people won't? For the most part solids will stay in the tank and break down while the liquids filter out throughout the finger system. If I get a glass of liquid from my finger system, will you drink it?

Nothing scares any government so much as to have a person who does not depend upon them for life.

What's the difference between the man's poo , and the horses poo he has on the property? Or, what if he had 20 head of cattle on his property? Would he need a septic system and potty trained cows? :dunno:

Guys, they already clarified that it didn't have anything to do with safety. It was just because the local busybodies who make the rules decided that they didn't like the appearance of anybody getting out of a mobile home every morning. So you either capitulate to their arbitrary rules or they will confiscate your land.

Yep. This is called a county, township, town, or neighborhood. The problems start when someone moves in the DOESN'T have the same values as the rest of the group.
So the pop from one man in a hole in the ground is going to contaminate the ground water but somehow a septic system being used by several people won't?
We still stuck on the poop? I thought we found out that waste disposal had nothing to do with this guy.

And yes, one guy's "pop" dumped on the ground could very well be worse than a whole family on septic.

No, but I will drink from your well.

Now, on the livestock comments: Yes, they will contaminate the water supply as well. Not quite as bad, as many livestock pathogens will not hurt humans. However, horse/cow/pig poop can cause many of the same problems as human poop. This is heavily regulated in highly populated areas. Not as regulated in rural areas. If you live "downstream" of a large farm, I really hope you have a deep well!

Backhanded attempt at calling me a communist? Or am I being too sensitive?

What's the old saying.... If you can't win with facts, attack their character?

I know all of us on the outside looking in are upset by the result, but the folks of Madison County are more than welcome to "fix" this. They could have shown up at his Zoning hearing, shown up at his trial, written letters, or even work to change the zoning ordinances now so the guy can move back in. The beauty of local government: WE control it.

(BTW: I hope I'm wrong about the attempted insult. If so, I apologize in advance. If not....)

Lessee. Collective rights are more important than individual rights. What political ideology does that fall under?

Your kitchen may be hazardous and cause a fire which in turn will burn down your entire neighborhood. Starting tomorrow, there will be daily cleanliness inspections by your local Nazi of the state. Afterall, your neighbors have a vested interest in your property.

How much do you want to bet they will want him to keep paying the taxes on "his" land when they kick him off of it?

    Craziness.

One thing some of our more socialist members keep missing, this guy does not live in an association or even in a city.

He lives on 38 acres... in the county.

Some people would like to believe that they can live in their condo and have their Kondo-Kommandos send out edicts to the guy 30 miles away living outside their little association.

Property Rights are not subject to the whim of a bunch of socialists. If you want to go build your own little Jonestown style fascist retreat with laws about how big your flags can be and if you can park a pickup in the driveway over night, go for it. Get a bunch of contiguous property owners together and sign into your own association.

Don't try and take the whole fracking county into your socialist utopia with you.

Either people have Rights or they don't. It's that simple.

Just curious, is his land located near the new proposed roads Madison County wants to build. There are several other people that may loose their homes to eminent domain.

Lessee. Collective rights are more important than individual rights. What political ideology does that fall under?
Democracy, I think. Rule of the Many.

I believe you are confusing communism (all property owned by the state) with our democracy (individual rights restricted by elected representatives). We are a nation of laws, and we chose who gets to make and enforce those laws.

"Communist" is a nice, inflammatory term, so I know why you used it. Calling me a "Representative Republican" doesn't have the same ring to it :D

Your kitchen may be hazardous and cause a fire which in turn will burn down your entire neighborhood. Starting tomorrow, there will be daily cleanliness inspections by your local Nazi of the state. Afterall, your neighbors have a vested interest in your property.
Yep. Your local zoning ordinances and building codes cover this as well. Your kitchen is inspected when built and during any major remodel. If you make major changes WITHOUT an inspection, then you can be fined and have your work torn out (or the property seized).

BTW: Never said I agree with any of this. I really do feel for the guy. I'm just trying to point out a few things I think a lot of folks miss:
    - there is more to this story than some dude living in a trailer
    - the media is working us like puppets
    - zoning laws aren't about giving some old guy the boot, they are about balancing YOUR rights with your NEIGHBOR'S rights.
    - we all elected the folks that put these laws on the books. If we don't like them, look in the mirror first. Zoning committees are usually elected positions, the meetings are open, and area residents are welcome to attend.
