    How about.....Criminalize and prosecute actions responsible for victims. No victim, no crime.

    You T-bone someone and kill them because you were distracted.....You should be punished accordingly. And it should be a DAMN HARSH penalty. Harsh enough that people just flat out won't risk texting and driving. The REAL problem here is that the punishment is not currently harsh enough to deter people.

    It should not be the .gov's job to babysit adults and to police people's use of their phones.

    I agree, except: why should being distracted be relevant? If someone is responsible for the T-bone that results in the death of someone in the other car, the penalty should be harsh, regardless of the reason for the T-bone.

    Wait, wut? Some guy runs a redlight, and another having the right of way t-bones him and kills him, and he should be prosecuted? Just sayin’?

    In that case, the person responsible for the T-bone is the one who ran the red light, and got himself T-boned. The other driver is not at fault - distracted or otherwise.
