    Kirk needs a little help with his written Yiddish: "schtüping". Yes, there are those who use "stooping"...but c'mon.

    I thought I posted this earlier. She made a mistake about which apartment she was entering. Even though it was a mistake, she is still responsible for the bullet that left her gun. Was she in danger? In fear for her life? I think her mistake created her own fear and unfortunately she shot an innocent homeowner. Bad luck for both of them. Her being an officer I would think she would go in, but me I wouldn't if I'm safe outside.

    Yes, fear for your life cannot be due to your own negligent or illegal actions IMO

    Exactly; the fear for one's life must be objectively reasonable. Or, in other words, what we as society are willing to accept.

    Indiana's law on the use of force to protect one's dwelling:

    (d) A person:(1) is justified in using reasonable force, including deadly force, against any other person; and
    (2) does not have a duty to retreat;
    if the person reasonably believes that the force is necessary to prevent or terminate the other person's unlawful entry of or attack on the person's dwelling, curtilage, or occupied motor vehicle.

    DA got a warrant on 9/11 and seized the locks to both Guyger's and Jean's apartments. Since they are some sort of "smart" lock, they have data in them that may show when and how the locks were opened. The keys have RFID chips in them. Data from elevator use is also sought, so maybe the elevators require resident key to use them.

    What do all of this? Trying to see if truly innocent mistake about which apartment or if it was premeditated somehow? Didn’t she visibly change when she realized what happened?

    Yeah, I think it is to piece together whether there was some sort of relationship there. Also, whether such a mistake had happened in the past. She might've told the investigators it had happened before, but the door was locked or she realized the mistake before... well... before shooting anyone.

    The door lock info may corroborate or disprove her story to some degree. IIRC it was reported that she said the door opened when she put her key in, indicating (since it was the wrong door) that it might have been unlocked or even open a bit. If the lock data shows the door was closed and locked, she has some more 'splaining to do. If the data shows she went to her own apartment first and then to Jean's, then she has some serious 'splaining to do. And if the data shows that Jean's door was unlocked, or that her key would have opened Jean's lock even though it was the wrong door, that shores up her version of the story. (The last occurs to me because I just had one of my UHaul customers take the right key, get in the wrong truck...and drive off.)
