    Donald Trump's former lawyer Tim Parlatore told CNN on Saturday that the Mar-a-Lago classified documents case represents "the biggest threat" to the former president. Other legal notables such as Dershowitz and Turley have said the same.

    "I've always considered the Mar-a-Lago case to be the most -- the biggest threat. You know, the claims in there if it can be proven about the obstruction, I think that is the case that is most likely to -- if he is convicted, to survive an appeal."

    Could it be another case of Trump shooting himself in the foot such as attempting to obstruct if convicted?

    This is an interesting situation. The prosecution must share all evidence with the accused legal team. The J6 committee gave Smith the evidence against Trump, but destroyed all other evidence not in the official record, including exculpatory evidence. Several high profile convictions have been overturned on this basis by SCOTUS in the last twenty years or so. What will SCOTUS do with this? Might be an easy way out, which is what I expect from this court.

    You are talking about discovery. If the prosecutor has information they are required to share it with the defendant. This may be different as the Committee is not the prosecutor. DOn;t know whether that amkes a difference or not.

    You are talking about discovery. If the prosecutor has information they are required to share it with the defendant. This may be different as the Committee is not the prosecutor. DOn;t know whether that amkes a difference or not.
    I kind of doubt we ever get to that issue, but maybe it could be an unacknowledged factor in a decision.

    Before we get to any merits, there are weighty decisions on if Smiths appointment is constitutional, presidential immunity, free speech. A lot of SCOTUS to come…

Says he did nothing wrong; He worked very hard on voter fraud and should be afforded immunity for just trying to do his job to insure fair elections. He argues that a POTUS has to have immunity to do their job.

    And he does. Where does it start and stop? Can Obama be charged for ordering killings of terrorists? Isn’t that murder! Are the terrorists not just political rivals?

    That's part of his argument. It seems like other presidents like Obama are afforded immunity for "just doing their job" but he's not. Trump says he's singled out because he's Trump.

    I think many people on both sides have gone along in ignorant bliss, never studied the constitution, and are shocked at the powers a president were given in the constitution. This was manifest here by the incredulity at the idea the president has total control of the documents of his administration. Lots of “the president isn’t above the law” type statements.

    To a big extent he is.

"…a review of the amount of money that the special prosecutor has been paid by the district attorney and the personal activities of the district attorney and the special prosecutor during the pendency of this prosecution shed light on just how self-serving this arrangement has been," wrote Merchant in the complaint. The power pair are accused of enjoying trips to Florida and Napa Valley and indulging themselves on tropical cruises, among other extravagances”

    President Trump and his legal team also make the case that if the POTUS doesn't have immunity it effects their sole discretion as Chief Executive in decision making out of fear of prosecution.

    Also, if they don't have 1st amendment immunity it would make them reticent to speak openly to address the nation and the press out of fear of defamation and civil claims.

    This has stink all over it. These crooked DA's, AGs and prosecutors commit all kinds of border line criminal acts and certainly ethical violations. From things like openly campaigning to "Get Trump" and now things like this.

    If the president didn't have immunity, then he could end up with lawsuits for policy decisions causing negative outcomes to people.

    I mean I guess it would be cool to be able to sue the president for something you don't like, but then we wouldn't really have an effective government.

    Where immunity ends is with impeachment, after impeachment, then legal considerations can be brought. But if they can't secure impeachment in the house and the senate, they really need to hang it up and move on.

    On a technical basis a president should be able to commit murder in broad daylight with total legal immunity, up until the point that he is impeached in the house and senate. This isn't just the way things should be, it's a necessity for a litany of reasons that wouldn't be readily apparent to everyone until tested.

    I think we're just at the end of this experiment in governance. If we can't accept the surface level premise of the constitution and need a court to settle every single letter and piece of punctuation, in attempts to subvert it, we don't have a country.

    We exist on a gentleman's agreement to abide to a document for our own interests. And it seems that agreement is being tossed out.
