    While I believe the President has total control of the documents of his administration this is interesting. But if obummer can do this by EO, doesn’t that mean he already has unfettered authority over documents?


    Interesting. One question though has it been established that Trump ever read such a memo to give him the following impression? This is the first time that I have seen mention of it. Don't believe Trump has ever cited the memo as a defense before.

    America First goes on to explain that "Obama’s PITC memo may have created a reasonable belief in President Trump that he, in fact, had such authority" to "possess or retain... classified documents."

    Text, precedent, and executive practice reinforce the historical tradition. The records a President creates or receives while performing the duties of his office are his presidential records. That test does not depend on the content of the records, or whether the records are classified. The test does not change when a President leaves office. If, for example, a former President acquires new records after leaving office, those new records would not enjoy the same constitutional status as his presidential records acquired while in office. But the Presidential records a President takes with him upon vacating the presidency are his, to do with as he pleases. The President can keep them, sell them, destroy them, or donate them, as all Presidents have done.

    I found this part to be an interesting argument in that the POTUS has sole control over documents unless he voluntarily relinquishes control and gives them to the federal government. It's his voluntary call to make though without being coerced into doing so under threat of legal action. They can't force him to hand them over.

    The Presidential Records Act could be read to apply only to presidential papers that the President voluntarily relinquishes. That more limited interpretation preserves the historical power of the Executive as well as the procedures Congress has established governing how executive officials handle presidential records. Until the President voluntarily gives his records to the federal government, they remain his alone. Any contrary reading contradicts the text, history, and constitutional structure.

    The Biden and Democrat election interference agenda is desperate to get a trial and conviction before the Nov. election. It's looking like they might have to pin their hopes on the NY DA Bragg Stormy Daniels case to fulfill their wishes. With all of the other indictment delays the Bragg case out of the four separate criminal indictments is the one most likely to proceed on schedule.


    New York University law professor Stephen Gillers told Newsweek on Thursday that the Florida trial will likely not go ahead before the election and that two of the other cases might be delayed beyond November.

    He went on to say that the Stormy Daniels case is the most likely to go ahead on time.

    "There is no reason to delay the New York State case, which could still meet its late March trial date if the trial in D.C. is pushed into May or June," he said. "So right now, pending further developments in D.C. and Georgia, it looks like the N.Y. case may go first and close to schedule. But I emphasize that the odds can change tomorrow."

    Would a Hollywood casting department cast the motley cast of characters prosecuting Trump? Or is it too unbelievable to an audience? The crazy, dirty, out of their mind overtly partisan prosecutors, James, Bragg, and Willis are beyond anything Hollywood has dreamt up. But, Soros money out them there, so here we are.

    Next there are the judges. All of them, with the possible exception of Judge Cannon, are leftist political hacks with so many partisan rulings it is becoming evident how bad the judicial bench has become. A look at the two judges in NY, thin skinned egomaniacs children issuing rulings.

    There is no doubt that the four indictments were assembled by a motley cast of avowed Trump hating partisans who are coinciding with a singular goal and that is to get a conviction before the election to help Biden. That includes some Judges, prosecutors and venues that are stacked with a like-minded jury pool which increases the odds of securing at least one criminal conviction.

    Weaponization of federal law occurs when an individual or group is targeted explicitly to do harm to said group/individual. An example of this would be MLK receiving threats from the feds and eventually (allegedly) being murdered for him threatening the status quo I.e. centralizing black labor power. I believe Trump is being attacked because it riles up people and contributes to campaign funding for BOTH sides. It's either a cooperative attack between the DNC and the GOP (includes all media, and other collaborators) or the precedent is being set to establish easier political retaliation from either side of the political party, whether it's being conducted by the DNC, GOP, or both it doesn't really matter because it's all benefitting the same people i.e. the lobbyists and their backers.
