    I just can't imagine shooting a guy on the ground that many times.... even if initially justified in engaging with deadly force.

    Really? What was the ratio of shots standing vs. shots while he is down?

    CPD trained to shoot until weapon out of hand?

    No idea, but you can see the victim's body jerk from the rounds entering his body, as it's on the ground. The span is quite lengthy. Of you look closely you can see the ricochets off the ground.

    1st Degree murder charge is absolutely BS and he will not likely be found guilty. The stench of politics is strong here.

    Did you read Illinois' murder statute before posting?
    I read it, it is not much different than here. Still don't think it will stick. If there is a lesser included offense of 2nd degree...MAYBE

    circumstances to be such that, if they existed, would justify or exonerate the killing under the principles stated in Article 7 of this Code, but his or her belief is unreasonable.

    Good luck when you do that then as you can expect a 1st degree murder charge as well...

    It went from a possible good shoot to a bad one in less then a second, you cannot shoot someone all the way to the ground, rounds bouncing off the ground are not going to help your case.

    In Illinois 2nd degree murder is always a lesser included. Look at the burden shifting language and the fact that the state has to prove the elements of first-degree to get a conviction for first or 2nd degree.

    Since the defense has to prove a mitigator by preponderance, second degree is not a charge really ever filed in Illinois except in really weird circumstances since the state has to prove the same elements for 1st degree and second. 2nd degree is basically manslaughter, but with a burden shift.

    It is completely and fundamentally different from Indiana's murder statute.
