    Not in Indiana.

At least, I *think* there was a case from the late 90s or early 2000s where a guy lifted up his shirt to flash a handgun in his waistband. On appeal, that was deemed to not be intimidation.

That's from memory, though, so someone else might be able to find the case - or a newer one.

That case if it's the one I'm thinking of it was found to be intimidation, based on the guy saying "Don't even think about it". Guy stops at a stop sign and get's out to talk to a panhandler, guy behind him honks horn and get's flipped off for it. Guy get's out of the car, the guy talking to the panhandler raises his shirt and says don't even think about it. Other guy get's back in his car and calls it in (off duty LEO).

Another case, two guys driving down the road yelling back and forth at each other through closed car windows. Guy raises a pistol and waves it(no pointing at other driver). Was found not to be intimidation due to the fact that the other driver stated he couldn't understand what was being said through the closed windows.

Based on the story posted from a representative of IMPD, it may not have risen to a criminal act but still not a wise way of handling the situation. By either person. Driver with camera should have gone around the guy and went about his way. Guy in pic shouldn't have got out in what could have been a perceived threatening manner.

But as a fat ass myself, I would say to all you INgo ninjas don't under estimate how quickly a big guy can move or how nimble he could be with the adrenalin pumping. I have surprised a few people how fast I can move when the need arises.
Kinda stereotypical how some judged this guy based on his appearance too. Sorry but that just shows a lack of class guys. Yep kinda bothered me bc this dude is dressed much the same as I would.
Almost like so many I have seen in line at gun shows with their 5.11 wardrobe or the tacticool junkie at the range who tend to speak extra loud when spewing a bs story in a show of their machismo.
If we want to grow our community we need to be careful about how we stereotype people. This could have been a new gun ownwer who acted based on the crap he "learned" at a LGS.

Ok done with my rant. Carry on, just don't get carried away

Settle down, amigo. IMPD Southeast District already said you didn't do anything wrong.

    ...

    Nah, I'm good.

But you're right about underestimating. Size doesn't mean a lot when it comes to closing short distances and reacting.

Ah, right - your memory is clearer than mine. I remember that other case, now, too.

The key is the communication of the threat. If not threat is communicated, there's no intimidation.

Brandishing, like "5" for the Holy Hand Grenade of Antioch, is right out. In Indiana.

OK OK.....I see a non-scientific test session coming of this.

Y'know, sometimes i wish I could just go through life taking things at face value and choosing up sides in an instant. It seems so simple.

But, alas, I am destined to be ever suspicious and cynical. It's a curse....but at least it's a curse that pays a living wage.

Yeah, if someone is following you call the freakin cops and let them handle that crap.

DON'T GET OUT OF THE CAR TO PROVOKE A CONFRONTATION.

    WTH?! Use your head people.

Well, if I'm just being followed, then I'm off to the police department, after a few route changes to see if I'm being followed.
Since I've had problems with girlfriends' ex-boyfriends, I tend to be a bit paranoid and keep an eye on the mirror.

Don't worry sweetpea, I'm as cool as a glass of scotch on the rocks.
Edit- just to be clear sweetpea comment wasn't an insult just making light of the situation

Point I was making is not all is as it may seem. And we need to be careful how we reflect the image of responsible gun owners

Bubba should have heeded this advice. Following him or not, hopping out of the car and showing a firearm seems like a free face shoot to me? After all, copious amount of face shooting only leaves one guy to tell the story! “Officer, I accidentally cut bubba off, he then passed me and stopped, hopping out of the car and pulling a gun, I feared for my life, so I drew my firearm, and shot him.” Purple is necessary, implied, etc.

I don't get the anger when people are following behind you. If you've got a passive aggressive bone in your body, you've got the tailgater right where you want them. Use your devious brain and enjoy.

People don't make much sense. I'm mad cause that guy is tailgating me and that's dangerous cause he might hit me. Too many people's response is to suddenly hit the brakes which increases the probability that he will hit you, the outcome you didn't want.

Oh...that's too obvious. Never just slam on the brakes. Be imaginative.
